In the section 'Anwendbares Recht, Gerichtsstand, Schlussbestimmungen' of a set of General Terms and Conditions of Business - Sales for Business Clients there is the following sentence with the phrase given above :

Dies gilt auch für die Einbeziehung- und Wirksamkeitsprüfung [sic] dieser AGB.

It is the English equivalent for Einbeziehung- und Wirksamkeitsprüfung that I am looking for.

Message from the POster First: thanks to everyone for detailed and prompt proposals.
In the end I went with a fusion of the suggestions by Kim Metzger and Klaus Beyer, which produced "Review of inclusion and validity". It is incisive and short.
These suggestions appeared in discussion postings, rather than proposed translations. Pity.

It's a "review" rather than a "test". Einbeziehung here means the applicability or eligibility or relevancy of the matter at hand to become 'incorporated', i.e. to qualify as part of the whole.

Where the incorporation of standard terms have been expressly agreed upon by the parties no problem arises, but quite often the incorporation of the standard terms takes place by a mere reference in an oral communication or written communication to the inclusion of such terms. Sometimes the text of the standard terms will accompany the main agreement, for instance being printed on the back of an order form, but quite often the contract merely contains an incorporation clause without any accompanying text. Die in den Vorschriften über allgemeine Geschäftsbedingungen enthaltene Regelung, nach der eine Prüfung erfolgen müsse, ob eine Regelung wirksam in das Vertragsverhältnis einbezogen worden sei, gelte für Arbeitsverträge nicht. I don’t think that either effectiveness or efficacy is the best translation for Wirksamkeit here. It is not about whether the GTCs ‘work’ for the parties but whether they are valid (i.e. legally enforceable) in the sense of a severability clause: https://en.wikipedia.org/wiki/Severability

The context also makes it clear that Prüfung does not mean test here. It is about establishing or determining in a court of law whether the terms have been duly incorporated and/or are enforceable.

test of incorporation by reference and of business efficacy

Middling confidence level as I thought 'incorporation by ref.' is something else in the USA - possibly Kim's inclusion suggestion, but I can't pinpoint the term on a trawl of ProZ glossaries.

Incorporation of docs. by ref. also crops up in testamentary affairs where secret-trust letters, e.g. leaving property to an illegit. child or mistress, can be admitted to probate,

AGB: Gen. Terms and Condiitons incorporated by reference into any agreements and contracts etc: there's a whole line of cases in the UK on whether disclaimer of liability signs on car parking or motor repair shops have been properly 'incorporated' - cut to the late Lord Denning' judgments.....

Otherwise, quote: the "business efficacy" test the proposed term will be implied if it is necessary to give business efficacy to the contract'.

Arguably, the first ProZ weblink answer of 'not expressly referred to...' almost gets to the incproration idea, but not quite.

I've just spotted - ex post facto or 'after the event' - Lancashireman's and Kim's incorporation idea in the discussion entries and feel 'by reference' ought to go in and Wirksamkeit switch from validity or effectiveness to 'business efficacy'.
Example sentence:

The sentence as a whole gets only one hit, which makes me think it must be the text the asker is translating, and the previous sentence reads:
