30 REASONS - ALLOW COMMUNION TO DIVORCED AND HOMOSEXUALS?
Spiritual humility: to not believe that we know better than our predecessors in faith, or worse, than Jesus himself.

1- The Catholic Church, as Christ’s love, is and has always been unconditionally loving of all, praying for mercy (forgiveness and rehabilita-tion) for each and every person. It is not a conservative fortress to keep sinners out, but a mission to serve the world and lead it to salvation.
2- But just as Jesus, the Church is uncompromising with our sin. As with the woman caught in adultery, He does not condemn us, but He calls us to sin no more (Jn 8:11). Everyone is invited to the banquet, but must come dressed up (Mt 22:11). In good pastoral care, it does not matter what we have been or where we are coming from, but it does matter -and is everything- where we are going (Heb 10:26).
3-Real mercy has two intrinsic parts, approaching the sinner and helping him to rise (Jas 5:20) for his own good and the good of others. Without this second part it is a false mercy that becomes complicity, a promoter of sin, hindering the true mercy that heals. To accompany a sinner is never an end, but only a mean to the end which is to lead to conversion and to repent (Lk 5:32). Comparably, it is not loving a smiling and indul-gent mother who does not correct her children and allows them to ruin their lives with drugs or avoiding school. Love is not permissive of harm.
4- In a culture that rejects objective truth and embeds in relativism –“what is true for you might not be true for me”-, Jesus taught something very different, that He is the Truth (Jn 14:6). Truth is one, does not vary by conscience, region, culture or times, not divided in central-peripheral. The Church does not let sympathies cloud sound reasoning and compromise what is true, the deposit of faith entrusted to her by God himself.
5-The Church simply cannot change what the Holy Spirit has revealed to be true, it’s not unwillingness, it is impossibility, because it is just the witness, not the author, thus her role is to uphold, not to revolutionize. Revelation ended with the apostles and new insights cannot contradict it. Customs/practices can change, but not doctrines. God does not change for us, we must change for Him. To claim that God’s designs change is to imply that He is imperfect -and His Word is not eternal and inerrant-, or arbitrary, giving to some generations and demanding from others.
6- As a sign of her divine foundation the Catholic Church has remained firm, often boldly alone on truths that for centuries were accepted by all. She has not bowed to the enormous cultural pressures and of particular groups, for the truth about Christ and what He teaches cannot be determined by popular vote. A church that speaks like the world would have no reason to exist, she is to convert culture, not to follow it. The Church is not a democracy, its structure is patterned after the structure of heaven, which is an absolute monarchy with God on the throne.
7- The Church is not an institution for sociology, economics or the environment, there are many more knowledgeable, but it is the only one for the most important, the salvation of souls. Her concern is not to make persons feel good with their sin, or just their ‘social’ integration to her or the care of their material needs, but to save them for eternal life, and this is often difficult, such as taking up a cross (Lk 9:23; Mt 7:13; Mk 9:43). In example, the objective per se is not to end material poverty, but to cultivate charity and eliminate the sin of indifference and selfishness.
8- The Church loves the sinner (the person), but condemns sin (the act), like fighting a cancer that kills a loved one. God created the person, not sin, which is an election of the person -it would be evil and senseless to create sin and then save us from it-, and to accept a self-justifying sinner’s demand to stop opposing his sin would be to stop loving him. To consent one sin, even silently, opens the door to consent others and:
* Legitimizes it and invites others to engage on it. A pastor pulls from the pit of sin but must also protect others from falling in it -from the bad example/influence-, intentions that wouldn’t be possible if he gave any impression of approving sin, diminishing its gravity or without preaching;
* It is much more than just a tolerance to human weakness, it is a capitulation to evil, ignoring or diminishing the power of grace which is far
greater than sin and can enable us to conquer it. God does not command impossibles, grace abounds and can be grabbed if only reached for.
9- A condition for forgiveness is repentance (Mk 1:4, 6:12; Lk 13:3, 15:7, 17:3, 24:47), not ‘admission’. Even the murderer can be forgiven, but he has to repent. The first sign of repentance from him is to stop murdering. Or the thief who steals a car, must be exhorted to return the car if this was possible as a condition for absolution. It is unthinkable to advise him that after a year of penance and reflection he can start using the vehicle.
10- The consequence in the Church to knowingly and willingly remain in a state of sin is in pair with the inevitable consequences of sin in our lives, it separates us from God and this leads to despair. In the part of the Church it is no punishment, for the Eucharist is not a mere ‘practice’ or symbolic gesture of membership, but the real body and blood of Christ. Other underlying doctrine is that unrepented sin cannot be in union with God (Rev 21:27) because it continues to exist in the timeless realm of our souls and it’s incompatible with God’s essence and his love for the victims of our sin. Besides, receiving communion in such state is no help at all for the unrepented sinner because, as Saint Paul says, he then “eats and drinks judgement upon himself” (1 Cor 11:29) by the defiant appropriation of the divine while being decidedly against God’s will (Mt 7:21).
11- In a world that is bent on the immediate, the visible and the tangible –“good is whatever makes me smile now”-, guided by the Holy Spirit the Church sees beyond superficialities. Evil rarely comes without a clever and enticing disguise to mislead both sinners and pastors:
a - Of seemingly loving persons afflicted and rejected, but underneath there is a deep misunderstanding of real love and real self that wants to be spread. In fact, the rejection has never been on the side of God or of his Church, but on the side of the sinner who does not want to hear -not even from God- that he is doing something wrong, it’s a person’s self-exclusion from the light and from communion with God (Jn 3:19). The Eucharist is well within their reach if they’d just not prefer a distorted sexuality first (Rom 8:7). Who loves God follows His commands (1 Jn 2:4).
b - Incorrectly suggesting that sin is God’s creation –“I was made this way”- and equating the will to sin to innocent victims, denying our free will. We all sin, but the just regrets it (no ‘pride’) and desires to not fall again, not the acceptance of his sin by others or a license to sin (Jude 4).
c - Wrongly labeling disagreement and good advice as ‘hate’ and ‘bigotry’, but in reality they practice the intolerance that they denounce and disagreeing with Jesus, not with the person upholding His Word. Paradoxically while the Church seeks their good is criticized and despised by them, as many loving mothers endure with their children. But, as good shepherd, the Church spares no pain trying to lead to truth (Jn 10:11).
12- From pride emerges the false idea that everything is subject to man’s will and power, without limits (Gen 3). We want to define our nature, love, what is good, and even Christianity by ourselves and ignore their creator. This is self-deception because, as they came to exist without our making, the truth of them is outside of us, they do not depend from us, like the law of gravity, they don’t change based on how we feel about them. God alone knows what is best for us, we must trust on his providence, his order isn’t arbitrary, it is meant for our good, for our benefit, not his. Morality is the manual for our life and body by our creator, the commandments loving protectors of us.
13-Jesus gives us a ‘freedom from’ not a ‘freedom to’ (sin) (1 Jn 3:8). The fulfillment of the law is not to abolish it but to follow its goodness from the heart, by love (Mt 5:17-20). Since the first centuries the Church has dismissed as heresies recurring theories that suggest that sin has no gra-ve repercussions (antinomianism, casuistry, annihilationism, etc.), which would contradict many teachings of Jesus (Mt 18:8). Sin is the cause of suffering, clearly visible in this world -we’re outside of heaven because of sin-, it has direct damaging consequences (often irrevocable, even if forgiven), it removes grace and, because it is from the devil, when we open to it demons enter in our life to poison even unrelated matters.
14- Private belief or practice is one thing; attempting to spread a false belief or immoral practice, even with the government coercing those who disagree, is quite another. To this the Church stands up and proclaims the truth and its good reasons to not allow things that destroy the souls to disseminate, for this is far worse than to merely kill the body (Mt 10:28). The Church do not imposes, proposes; not to judge and condemn but to convert and save; it is not throwing of stones but of lifesavers. We are free to make our own choices and God alone can judge the human heart, but the Church would betray God and humanity if it didn’t uphold God’s will as the objective standard for all. This cannot be diluted or adapted to the supposed abilities of the person because the Church does not apply a purely human measure, but takes grace into account.
15- Any person can attend the mass and services, only self-excluded from the Eucharist if in mortal sin, preventing any display of sin, and must be open to hear charitable correction (Acts 2:38; 2 Tim 4:2; Mt 18:15-17, 28:20), for if the Church doesn’t do this, who else will? The word of God does not belong to shelves, it is to be proclaimed, all of it, not selectively, so that we may be ready (Mt 24:44). Mercy requires to tell persons the truth and not let them learn by trial and error, exposing them to dire consequences, and as St. Augustine said, failure to speak shares in the sinner’s guilt (Ez 3:18). Without this blazing of light and speaking of truth, there would be no hope for virtue and for everything that depends upon it.

WHAT IS WRONG WITH DIVORCE AND WHY IS IT A MAJOR CONCERN?
16-What God has joined no man can separate (Mk 10:6-12). When a matrimony is properly instituted two persons are transformed by God into one and divorce is simply impossible, false, an illusion: there cannot be ex-husband just as there is no ex-brother, ex-mother or ex-foot. There are no exceptions to “Thou shall not commit adultery” (Mt 5:28; Mt 19:16-18; 1 Cor 6:9), from St John the Baptist (Mk 6:18) to the English Martyrs, the Church knows of witnesses who shed their blood in defense of the sanctity of the marital bond.
17-In marriage love is at stake. Real love was revealed in the cross, its virtues are selflessness, fidelity, patience, forgiveness, perseverance, willing the good of the other, self-motivated, does not fail, life giving (1 Cor 13:4-8). It is not ‘feelings’, temporary convenience, lust, self-serving, use and discard. The true definition of love comes from God, who is love, everything else we attribute to love is a lie. In real love we find joy and if we follow a fictitious “love” there will be hurting and grieving. Love is a decision that does not depend on human emotions but on the truth of the good involved. The good news is that the love that you are required to give is the same love that is required from others for you.
18- The marital promise is a vow to love one another, it is directed to the person and not to his qualities, which can indeed vary. This promise can be maintained even when under some unsafe circumstances it is necessary to live apart, to suggest otherwise would lead to the absurd conclusion that to end marriage all one has to do is to victimize the spouse. Absurd also would be to say that to end marriage just need to have children with ‘the other’ or let some years pass. Only if the spouses take the marital promise seriously will they invest every effort into their choice and into their relationship, each will be the one and only chance for the other. Indissolubility of marriage means that the door remains always open for the other, to right any wrong and to forgive, as in God’s love, even in the case of separation from bed and roof.
19-Divorce, always originated in the will of one or two and not by misfortune (Mk 7:21), leads persons to suffer: the spouse that is left, the children who cannot have both their parents all the time or lose one forever, persons who deteriorate their capacity to bond having intimacy with multiple partners, the depressed or bitter because he can’t find real love, people isolated, without roots and without ties and ultimately abandoned. It gives love the untrue notion of finitude and because of this divorce will tend to repeat over again. To support this is not merciful.
20-Consenting divorce devalues the virtues inherent to love and marriage. It would implicitly tell those who change harming manners towards the spouse or children, who keep fidelity –and who refrain from flirting with married persons-, who forgive, who sacrifice, who keep loving when the spouse ages or loses attributes, or who endure hard times (health, economic, emotional, etc.) and stay in marriage, that they don’t have to, that they can just take the easy and pleasant and leave when it becomes difficult, with the same message laid out for future spouses and even influencing the love to our neighbor. It is unreasonable to propose or allow in the name of ‘love’ what is precisely opposed to love.
21-The family is the foundation of society and the cornerstone of family is marriage, where simple feelings are transformed into a decision and a mission, a lifelong sharing of destinies where couples grow in virtue and help each other get to heaven, and where children receive genuine love and the emotional learning for life. With a few exceptions, blood ties are stronger and the ideal to raise children, the natural unconditional bond that can bear the hardest trials such as caring in a long catastrophic illness. The future of humanity passes fundamentally by the family. When families are preserved and nurtured, there is lesser need of supplemental care by government social or human services and charities.
22- The current problems in the families were not caused by the Church’s teachings -they have been the same for two thousand years- but by turning away from them, their preaching far surpassed by the mass media constantly advertising the contrary. The relaxation some desire in the Catholic Church can be judged by its fruits (Mt 7:16), some protestant churches have experienced it and has proven to worsen the situation.
23- The Church needs to do everything in her power to enable people to contract valid marriages. The responsibility is to promote the real meaning of love and of marriage so that true love may exist -given/received- and part of this is to speak clearly the truth about indissolubility. This prevents or heals, rather than simply treat the symptoms. Examples and models of lasting families will make more good future families.
WHY IS HOMOSEXUALITY A SERIOUS ISSUE, A SIN?
24- All of Scripture teaches the unacceptability of homosexual behavior (Gen 19; Lev 18:22; Rom 1:27; 1 Cor 6:9; 1 Tim 1:10, 2 Pet 2:6-10; Jude 7).
25- The Catholic Church calls for respect and compassion to persons with homosexual tendencies, but firmly opposes homosexual behavior and any events arising from it or oriented to rationalize it as ‘good’ or ‘normal’ (Catechism 2357-2359).
26- It is God who shapes the body of man and woman, its sexual difference is not a stereotype, a chance product of blind evolution or an anonymous determination of elements. God could have created us unisex or joined man and woman from birth, but He chose to create two
(Mt 19:4-5) for our love and will to show, which find their authentic realization in cooperation with his plan, counterweighting our original sin.
27- The opposition to homosexual behavior is in no way an opposition to fraternal love. There is absolutely nothing wrong when two persons love each other, whether of the same sex, a 50-year old and an 8-year old, a father and daughter; or when a group of people love one another, or a man loves his dog. But erotic love between these is an aberration, contrary to divine -natural- law, prone to diseases.
28- Homosexuality is a rebellion against our nature and its Author, often the result of evil -abuse, dissipation or bad guidance-:
• It confuses friendship and admiration with the love reserved for man and woman;
• It is a delusion, IMPOSSIBLE as evidenced by the bodies. Whatever it consists of, it is not and cannot be sexual union;
• The twofold of our humanity is male and female, not heterosexual and homosexual. We are either a man or a woman, the body is the testimony, as deep as its DNA, it is a matter of biology, not of preference. There is no homosexual gene, brain part or hormone;
• Every human person is disposed on the most intimate of his/her very being toward the opposite sex. The physical and emotional comple-mentarity of man and woman is wonderful, being two halves of a human being, each gives to the other what is lacking and makes him/her whole. Only man and woman can unite their bodies in ‘one flesh’ and open in love their union towards the presence and action of God;
• It steals persons from the fullness of real love and its expression in sexual union open to the gift of life;
• To try to be different than our true gender is illusory and self-defeating, like to believe to be a car, eat through nose or walk with the arms;
• Leads to despair because the person with homosexual attraction cannot be reciprocated by most of the persons interested on;
• As confirmed by thousands of ex-homosexuals, it is possible to leave it -if this is really wanted, as with any other sin-;
• There is no victimless sin, in addition to harming the two in the homosexual relationship it transcends to affect others:
There are two persons in the opposite sex forsaken for no good reason;
Spreads its error when this disorder is wrongly portrayed as simply another option/nature -instead of as something impossible and a temptation of evil that should not be entertained- causing, especially in the youth, an unwarranted self-identity confusion upon friendship and admiration to persons of the same sex, and tainting friendships and fraternal love with doubt and temptation;
When homosexual unions demand children as a right, as if they were commodities and not persons with their own inherent rights, such as to know and to be loved by their biological parents. Undeniably God’s design calls for all human life to have a mother and a father, both are indispensable for conception in any way and they are also necessary for a child’s correct emotional growth. Homosexuality purposely withholds a father or a mother from the child and vice versa, ultimately creating a big hole in the child.
29- Some compare to women or race discriminations, but in those cases the due acceptance of their deeds did not involve consent to harming matters. Evolution and progress are only true when they enhance our souls, bodies, minds and relationships, not when they mutilate them, and love surpasses law to heal, not to preserve in illness or error. We must be good stewards (not masters) of the gifts of love and life.
30- When it is about sin, the intentions and circumstances can be alleviating or aggravating, but never justifying. Whether there is predisposi-tion to kill, lie, anger, homosexuality, etc. due to genetics, environment, habituation or any other cause, it does not make it any acceptable or less damaging (neither if there are other good deeds). By the virtues of self-mastery all of us are called to gradually and resolutely approach Christian perfection (Mt 5:48, Heb 12:14; 2 Pet 3:11), this is the real purpose of our lives, until our last breath, where we must help each other.

1- A Igreja Católica, tal com o amor de Cristo, tem e sempre teve um amor incondicional por todos, rezando pela misericórdia (pelo perdão e reabilitação) de toda e qualquer pessoa. Não é uma fortaleza conservadora para manter os pecadores longe, mas uma missão para servir o mundo e levá-lo à salvação.
2- Mas tal como Jesus, a Igreja é intransigente para com o pecado. Tal como à mulher apanhada em adultério, Ele não nos condena, mas apela a que não voltemos a pecar (Jn 8:11).Todos serão convidados para o banquete, mas devem vir bem vestidos (Mt 22:11). Numa correcta orientação pastoral, não interessa o que fomos ou de onde viemos, mas é importante – e isso é tudo – para onde vamos (Heb 10:26).
3 – A verdadeira misericórdia tem duas partes intrínsecas, chegarmos junto do pecador e ajudá-lo a erguer-se (Jas 5:20) para seu próprio bem e para o bem dos outros. Sem esta segunda parte, trata-se de uma falsa misericórdia que se transforma em cumplicidade, em promoção do pecado, dificultando a verdadeira misericórdia, A que cura. Acompanhar um pecador nunca é um objectivo, em si, mas apenas uma forma de conseguir alcançar o objectivo que é conduzir à conversão e ao arrependimento (Lk 5:32) . Podemos comparar isso com o facto de não ser amor, uma mãe sorridente e indulgente que não corrija os seus filhos e permita que eles destruam a sua vida, com drogas e fugindo à escola. O amor não é tolerante para com o mal.
4 – Numa cultura que rejeita a verdade objectiva e que está enraizada no relativismo - “o que é verdade para ti pode não ser verdade para mim” - Jesus ensinou algo muito diferente, ensinou que Ele é a Verdade (Jn 14:6). A verdade é só uma, não varia de acordo com a consciência, região, cultura ou tempo. A Igreja não deixa a simpatia ofuscar o raciocínio claro e comprometer o que é verdade, o depósito da fé confiada nela pelo próprio Deus.
5 – A Igreja não pode, pura e simplesmente, mudar o que o Espírito Santo revelou ser verdade, não se trata de falta de vontade, é impossível, porque é apenas a testemunha, não o autor, por isso o seu papel é defender, não revolucionar. A revelação terminou com os apóstolos e novas perspectivas não a podem contradizer. Costumes/práticas podem mudar, mas não a doutrina. Deus não muda para nós, nos é que temos que mudar por causa Dele. Alegar que os desígnos de Deus mudam seria admitir que Ele é imperfeito – e que a Sua Palavra não é eterna e infalível – ou arbitrário, dando a algumas gerações e exigindo a outras.
6 – Como sinal da sua origem divina, a Igreja Católica tem pemanecido firme, muitas vezes comppletamente só, em relação a verdades que, durante séculos, foram aceites por todos. Ela não se tem dobrado às enormes pressões culturais e a grupos específicos, porque a verdade sobre Cristo e o que Ele nos ensina não pode ser determinada pelo voto popular. Uma Igreja que fale como o resto do mundo não teria razão para existir, ela existe para modificar a cultura, não para a seguir. A Igreja não é uma democracia, a sua estrutura é modelada segundo a estrutura divina, que é uma monarquia absoluta com Deus no trono.
7 – A Igreja não é uma instituição para a sociologia, a economia, ou o meio-ambiente, há outras instituições mais bem informadas sobre isso, mas é a a única para aquilo que é mais importante, a salvação das almas. A sua preocupação não é fazer com que as pessoas se sintam bem com os seus pecados, ou apenas com a sua integração 'social', ou com a preocupação pelos seus bens materiais, mas sim salvá-las para a vida eterna, e isto é, com frequência, difícil, tal como carregar uma cruz (Lk 9:23; Mt 7:13; Mk 9:43) . Por exemplo, o objectivo 'per se' não é acabar com a pobreza material, mas cultivar a caridade e eliminar os pecados da indiferença e do egoísmo.
8 – A Igreja ama o pecador (a pessoa) mas condena o pecado (o acto), tal como se luta contra um cancro que mata uma pessoa amada. Deus criou a pessoa, não o pecado, o que significa uma escolha da pessoa – seria diabólico e sem sentido criar o pecado e depois salvar-nos dele – e aceitar, como auto-justificação de um pecador, o seu pedido para que deixemos de nos opor ao seu pecado, seria deixar de amá-lo. Aceitar um pecado, mesmo silenciosamente, abre a porta para que outros sejam aceites e:
* Legitima esse pecado e convida outros a praticá-lo. Um pastor retira as pessoas do poço do pecado mas também deve impedir que outros lá caiam – devido a maus exemplos/influência – um objectivo que não seria possível se ele transmitisse qualquer impressão de que aprovava o pecado, diminuindo a sua gravidade ou sem pregar contra essse pecado ;
* É muito mais do uma simples tolerância em relação à fraqueza humana, é uma capitulação perante o mal, ignorando ou diminuindo o poder da graça que é muito maior do que o poder do pecado e nos permite vencê-lo. Deus não nos pede o impossível, a graça é abundante e pode ser obtida, desde que a procuremos.
9 – Uma condição para o perdão é o arrependimento (Mk 1:4, 6:12; Lk 13:3, 15:7, 17:3, 24:47), não a 'confissão'. Até o assassino pode ser perdoado, mas em que se arrepender. O primeiro sinal de arrependimento da sua parte é parar de matar. Ou o ladrão que rouba um carro, deve ser exortado a devolver o carro, se for possível, como condição para a sua absolvição. É impensável aconselhá-lo a que, depois de um ano de penitência e reflexão, possa começar a usar o carro.
10 – As consequências, na Igreja, de conscientemente e voluntáriamente permanecer num estado de pecado, estão inevitavelmente ligadas às consequências do pecado na nossa vida, separam-nos de Deus e conduzem-nos ao desespero. Não é uma punição, por parte da Igreja, porque a Eucaristia não é uma mera 'prática' nem um gesto simbólico de ser membro de uma associação, mas o verdadeiro corpo e sangue de Cristo. Outra doutrina subjacente defende que um pecador não arrependido não pode estar em união com Deus (Rev 21:27) porque o pecado continua a existir na essência intemporal das nossas almas e é incompatível com a essência de Deus e o seu amor pelas vítimas dos nossos pecados. Para além disso, receber a comunhão numa situação dessas não ajuda em nada o pecador não-arrependido porque, como disse São Paulo, ele “bebe e come a sua própria condenação” (Rev 21:27) ao apropriar-se, de uma forma desafiadora, do divino, ao mesmo tempo que está, decididamente, contra o desejo de Deus (Mt 7:21).
11 – Num mundo que está virado para o imediato, o visível e o tangível - “bom é tudo aquilo que me faça sorrir agora” - a Igreja, guiada pelo Espírito Santo, vê para além dessas superficialidades. O mal raramente vem sem um disfarce inteliente e atraente, para enganar tanto os pecadores como os pastores:
a – Da parte de pessoas amorosas, aparentemente rejeitadas e aflitas, mas por trás disso, há um profundo mal-entendido do que é o verdadeiro amor e o seu verdadeiro 'eu', que se quer espalhar. De facto, a rejeição nunca veio do lado de Deus ou da Igreja, mas do lado do pecador que não quer ouvir – nem sequer de Deus – que ele está a fazer algo errado, é a própria pessoa que se auto-exclui da luz e da comunhão com Deus (Jn 3:19) . A Eucaristia está perfeitamente ao seu alcance se eles simplesmente não preferirem, em primeiro lugar, uma sexualidade distorcida (Rom 8:7). Quem ama Deus segue os Seus mandamentos (1 Jn 2:4).
b – Sugerindo incorrectamente que o pecado é uma criação de Deus - “Eu fui feito desta maneira” - e igualando a vontade de pecar à situação de uma vítima inocente, é negar a nossa capacidade de decidir livremente. Todos nós pecamos, mas o justo lamenta isso (sem 'orgulho') e deseja não voltar a cair novamente, não pretende que os outros aceitem o seu pecado ou ter uma licença para pecar (Jude 4).
c – Classificando, erradamente, o desacordo ou o bom conselho como 'ódio' ou 'intolerância', quando, na realidade, eles praticam a intolerância que denunciam e estão em desacordo com Jesus, não com as pessoas que defendem a Sua Palavra. Paradoxalmente, enquanto a Igreja procura o bem deles, é criticada e desprezada por eles, uma coisa semelhante ao que muitas mães amorosas têm que suportar, com os seus filhos. Mas, tal como um bom pastor, a Igreja não poupa esforços na tentativa de os levar à verdade (Jn 10:11).
12 – A falsa ideia de que tudo, sem limites, depende da vontade e do poder do homem, surge a partir do orgulho (Gen 3). Queremos definir a nossa própria natureza, o amor, o que é bom e até o Cristianismo, apenas por nós próprios e ignorando o seu criador. Isto é enganarmo-nos a nós próprios porque, tal como eles existem sem a nossa intervenção, a verdade deles está fora de nós, eles não dependem de nós, tal como a lei da gravidade, eles não mudam de acordo com o que nós sentimos por eles. Apenas Deus sabe o que é melhor para nós, temos que confiar na sua providência, a sua ordem não é arbitrária, é destinada ao nosso bem, é para o nosso benefício, não dele. A moral é um manual para a nossa vida e para o nosso corpo, com origem no nosso criador, os mandamentos são os nossos amorosos protectores.
13 – Jesus dá-nos uma 'liberdade de', não uma 'liberdade para' (pecar) (1 Jn 3:8). O cumprimento da lei não consiste em aboli-la mas seguir a sua bondade do fundo do coração, através do amor (Mt 5:17-20). Desde os primeiros séculos que a Igreja tem rejeitado, como heresias, teorias recorrentes que sugerem que o pecado não tem repercursões graves (o atinomismo, a casuística, o aniquilacionismo, etc) o que contradiz muitos dos ensinamentos de Jesus (Mt 18:8). O pecado é a causa do sofrimento, claramente visível neste mundo – estamos fora do paraíso por causa do pecado – e tem consequências directas e danosas (muitas vezes definitivas, mesmo se perdoados), afasta a graça e, como é proveniente do demónio, quando nos abrimos a ele, os demónios entram na nossa vida, envenenando até coisas que não têm relação directa com isso.
14 – Uma crença ou uma prática privada, é uma coisa; tentar fazer alastrar uma crença falsa ou imoral, mesmo com o governo a exercer pressão sobre quem discorda, é algo completamente diferente. Perante isto, a Igreja mantém-se firme e proclama a verdade e as suas boas razões para não permitir que seja disseminado algo que destrói as almas, porque isto é muito pior do que matar apenas o corpo (Mt 10:28). A Igreja não impõe, propõe não julgar e condenar, mas sim converter e salvar; não se trata de atirar pedras, mas salva-vidas. Nós somos livres para fazer as nossas próprias escolhas mas só Deus pode julgar o coração humanos, e a Igreja trairía Deus e a humanidade se não defendesse o desígio de Deus como o objectivo modelo para todos. Isto não pode ser diluído ou adaptado às supostas capacidades das pessoas porque a Igreja não aplica uma medida puramente humana, mas leva em conta a graça.
15 – Qualquer pessoa pode assistir à missa e aos serviços religiosos, só se devem auto-excluir da Eucaristia se estiverem em pecado mortal, evitando qualquer demonstração de pecado, e devem estar abertos a ouvir observações tolerantes (Acts 2:38; 2 Tim 4:2; Mt 18:15-17, 28:20), porque se a Igreja não o fizer, quem mais o fará? A palavra de Deus não deve ficar nas prateleiras, deve ser proclamada, toda ela, sem ser selectivamente, para que nós possamos estar prontos (Mt 24:44). A misericórdia requer que digamos às pessoas a verdade e não as deixemos aprender através de tentativas e erros, expondodo-as a terríveis consequências e, como disse Santo Agostinho, não falar é ser também responsável pela culpa do pecador (Ez 3:18). Sem este clarão de luz e sem se dizer a verdade, não haverá esperança para a virtude e para tudo o que depende dela.

O QUE É HÁ DE ERRADO COM O DIVÓRCIO E PORQUE É UMA GRANDE PREOCUPAÇÃO?
16 – O que Deus juntou o homem não pode separar (Mk 10:6-12). Quando um matrimónio é devidamente instituído, duas pessoas são transformadas por Deus numa só e o divórcio é simplesmente impossível, falso, uma ilusão: não pode existir um ex-marido, tal como não pode haver um ex-irmão ou um ex-pé. Não há excepções ao “Não cometerás adultério” (Mt 5:28; Mt 19:16-18; 1 Cor 6:9), e desde São Jão Baptista (Mk 6:18) aos Mártires Ingleses, a Igreja conhece as testemunhas que derramaram o seu sangue en defesa da santidade dos laços matrimoniais.
17 – No casamento, o amor está em causa. O verdadeiro amor foi revelado na cruz, as suas virtudes são a abnegação, a fidelidade, a paciência, o perdão, a perserverança, desejar o melhor para o outro, a auto-motivação, não falhar, dar vida (1 Cor 13:4-8). Nao se trata de 'sentimentos', conveniência temporária, luxúria, auto-aproveitamento, usar e deitar fora. A verdadeira definição de amor vem de Deus, que é amor, e tudo o mais que atribuamos ao amor é uma mentira. No verdadeiro amor encontramos a felicidade e se seguirmos um “amor” ficcional, isso produzirá dor e tristeza. O amor é uma decisão que não depende das emoções humanas mas da verdade do bem envolvidos. As boas notícias são que o amor que é necessário dar é o mesmo amor que é necessário que os outros vos dêm.
18 – A promessa matrimonial é um voto de amor, um pelo outro, é dirigido à pessoa e não às suas qualidades, que podem, de facto, variar. Esta promessa pode ser mantida mesmo quando, perante determinadas situações arriscadas seja necessário viverem separados, sugerir outra coisa levaria à absurda conclusão de que, para acabar com um casamento, tudo que seria preciso fazer seria maltratar a esposa. Absurdo também seria dizer que, para acabar com um casamento, seria apenas necessário ter filhos com “o outro” ou deixar passar alguns anos. Só se os esposos levarem a prmessa matrimonial a sério é que investirão os seus esforços nessa escolha e na sua relação, cada um será uma e a única oportunidade para o outro. A indissolubilidade do casamento significa que a porta está sempre aberta para o outro, para corrigir qualquer erro e perdoar, tal como no amor de Deus, mesmo no caso de separação de cama e casa.
19 – O divórcio, que tem sempre origem na vontade de um ou de ambos e nunca por infortúnio (Mk 7:21), leva as pessoas ao sofrimento: o esposo que fica só, as crianças que não podem ter ambos os pais durante todo o tempo ou que perdem um deles para sempre, pessoas cuja capacidade de relacionamento se vai deteriorando devido ao facto de terem múltiplos parceiros, pessoas deprimidas ou amargas porque não conseguem encontrar o verdadeiro amor, pessoas isoladas, sem raízes e sem laços e, por fim, abandonadas. Dá ao amor a noção falsa de finitude e, por causa disso, o divórcio tem a tendênca para se repetir, uma e outra vez. Apoiar isto não é ser misericordioso.
20 – Admitir o divórcio desvaloriza as virtudes inerentes ao amor e ao casamento. Isso fará com que, implicitamente, aqueles que mudam o seu mau comportamento para com a esposa ou os flhos, que se mantêm fiéis – e que se abstêm de namoriscar com pessoas casadas – aqueles que perdoam, que se sacrificam, que continuam a amar quando a esposa envelhece ou perde qualidades, aqueles que aguentam tempos difícieis (em termos de saúde, económicos, emocionais, etc) e se mantêm casados, pensem que podem tomar o caminho mais fácil e agradável e irem-se embora quando o casamento se torna difícil, com a mesma mensagem a ser dada aos futuros esposos e até a influenciar o amor pelo próximo. Não é razoável propor ou permitir, em nome do 'amor' algo que é precisamente o oposto do amor.
21 – A família é a base da sociede e o pilar da família é o casamento, onde os simples sentimentos são transformados numa decisão e numa missão, um partilhar de destinos para toda a vida onde os casais crescem em virtude e se ajudam mutuamente a chegar ao paraíso, e onde as crianças recebem um amor genuíno e uma aprendizagem emocional para a sua vida. Com poucas excepções, os laços de sangue são mais fortes e são os ideiais para criar os flhos, o laço incondicional que aguenta as piores situações, tal como cuidar de alguém numa longa e terrível doença. O futuro da humanidade passa fundamentalmente pela família. Quando as famílias são preservadas e cultivadas, há uma menor necessidade de um cuidado suplementar por parte dos serviços sociais e das organizações de caridade.
22 – Os actuais problemas das famílias não são causados pelos ensinamentos da Igreja – têm sido os mesmos, desde há dois mil anos – mas devido ao facto de se desviarem desses ensinamentos, a sua pregação é largamente ultrapassada pelos meios de Comunicação Social, que pubilicitam constantemente o contrário. A “suavização” que alguns desejam que a Igreja Católica aplique pode ser julgada pelos seus frutos (Mt 7:16), algumas igrejas protestantes experimentaram isso e apenas se provou que piorava a situação,
23 – A Igreja precisa de fazer tudo o que estiver ao seu alcance para permitir que as pessoas celebrem casamentos válidos. A responsabilidade está em promover o verdadeiro significado de amor e casamento para que o verdadeiro amor – dar/receber – possa existir e faz parte disto falar claramente da verdade sobre a indissolubilidade. Isto previne ou cura, em vez de simplesmente tratar os sintomas. Exemplos e modelos de famílias duradouras produzirão mais famílias boas, no futuro.
PORQUE É QUE A HOMOSSEXUALIDADE É UM ASSUNTO SÉRIO, UM PECADO?
24 – Todas as Escrituras destacam a impossibilidade de se aceitar o comportamento homossexual (Gen 19; Lev 18:22; Rom 1:27; 1 Cor 6:9; 1 Tim 1:10, 2 Pet 2:6-10; Jude 7).
25- A Igreja Católica apela ao respeito e compaixão pelas pessoas com tendências homossexuais, mas opõe-se firmemente ao comportamento homossexual e a qualquer iniciativa surgida a partir daí ou orientada para o racionalizar como 'bom' ou 'normal' (Catechism 2357-2359).
26 – Foi Deus que formou o corpo do homem e da mulher, as suas diferenças sexuais não são estereótipos, um produto casual de uma evolução cega ou uma determinação de elementos desconhecidos. Deus poderia ter-nos criado unisexuais ou juntar homem e mulher logo a partiir do nascimento, mas Ele escolheu criar dois (Mt 19:4-5) para que pudéssesmos mostrar o nosso amor e a nossa vontade, que encontram a sua perfeita realização em cooperação com o seu plano, para contrabalançar o nosso pecado original.
27 – A oposição ao comportamento homossexual não é, de forma nenhuma, uma oposição ao amor fraternal. Não há nada absolutamente errado com o facto de duas pessoas se amarem uma à outra, mesmo que sejam do mesmo sexo, quer seja um homem de 50 anos e uma criança de 8 anos, um pai e uma filha, ou quando um grupo de pessoas se amam uns aos outros ou quando um homem ama o seu cão. Mas o amor erótico entre eles é uma aberração, é contrário à lei natural divina, e suceptível de provocar doenças.
28 – A homossexualidade é uma rebelião contra a natureza e o seu Autor, frequentemente o resultado do mal – abusos, dissipação ou má-orientação:
• confunde amizade e admiração com o amor reservado ao homem e à mulher;
• é uma desilusão, IMPOSSÍVEL tal como se torna evidente pela forma dos nossos corpos. Seja o que for, não é e não pode ser uma união sexual;
• as duas parte da humanidade são macho e fêmea, não heterossexuais e homossexuais. Nós somos ou mulher ou homem, e o corpo é testemunho disso, algo de tão profundo como o nosso ADN, é uma questão de biologia, não de preferência. Não há um gene, uma parte do cérebro ou uma hormona homossexual;
• todo o ser humano está orientado, no mais íntimo da sua/seu ser em direcção ao sexo oposto. A complementaridade física e emocional do homem e da mulher é maravilhosa, sendo cada um metade de um ser humano, cada um dá ao outro o que lhe falta e faz dela/dele um ser completo. Só um homem e uma mulher é que podem unir os seus corpos 'numa só carne' e desenvolver a sua união, através do amor, em direcção à presença e acção de Deus;
• rouba às pessoas a plenitude do verdadeiro amor e a sua expressão, através da união sexual, aberta à oferta da vida;
• tentar ser diferente do nosso próprio género é ilusório e auto-destrutivo, tal como acreditar que se é um carro, comer através do nariz ou andar com os braços;
• conduz ao desespero porque a pessoa que sente uma atracção homossexual não encontra resposta por parte da maioria das outras pessoas;
• ttal como é confirmado por milhares de ex-homossexuais, é possível deixar de o ser – se o quiserem, realmente, tal como em relação a qualquer outro pecado;
• não há pecado que não provoque vítimas, para além de magoar os dois que se envolvem numa relação homossexual, isso transcende esses efeitos e afecta outras pessoas;
Há duas pessoas do sexo oposto abandonadas sem qualquer razão;
Este erro espalha-se quando este distúrbio é erradamente retratado como simplesmente uma outra escolha/natureza – em vez de algo impossível ou uma tentação do demónio que não deveria ser admitida – causando, especialmente entre os jovens, uma injustificável confusão da sua própria identidade, em relação à amizade e respeito por pessoas do mesmo sexo, e envenenando a amizade e o amor fraternal com dúvidas e tentações;
Quando “casais” homossexuais exigem crianças, fazem-no como sendo um direito, como se elas fossem uma mercadoria e não pessoas com os seus próprios e inerentes direitos, tal como conhecerem e serem amados pelos seus pais biológicos. Sem qualquer dúvida que o desígnio de Deus exige que qualquer vida humana tenha um pai e uma mãe, ambos são indispensáveis para a concepção, de qualquer forma, e são também necessários para um correcto desenvolvimento emocional da criança. A homossexualidade impede, intencionalmente, que uma criança tenha um pai ou uma mãe, criando um enorme vazio na criança.
29 – Alguns comparam isto à discriminação contra mulheres ou à discriminação racial, mas nesses casos a aceitação dos seus actos não envolve o consentimento da prática de actos prejudiciais. A evolução e o progresso só são verdadeiros quando melhoram as nossas almas, corpos, mentes e relacionamentos, não quando os mutilam, e o amor ultrapasssa a lei, para curar, não para insistir na doença ou no erro. Temos que ser bons gestores (não donos) das dádivas de amor e vida.
30 – Quando se trata de pecados, as circunstâncias podem ser atenuantes ou agravantes, mas nunca justificativas. Quer haja uma pré-disposição para matar, mentir, ficar furioso, ser homossexual, etc, devido a factores genético, ambientais, aos hábitos ou a qualquer outra causa, isso não faz com esses actos sejam aceitáveis ou menos danosos (nem mesmo que haja outros actos bons). Através das virtudes do auto-controle, todos nós somos chamados a, gradualmente e resolutamente, nos aproximarmos da perfeição Cristã (Mt 5:48, Heb 12:14; 2 Pet 3:11), é este o verdadeiro propósito das nossas vidas, até ao nosso último suspiro, em relação ao qual nos devemos ajudar uns aos outros.

re: The Disappearance of Madeleine McCann: New evidence of what happened to her
We are a group of mainly British researchers. Most of us have studied the disappearance of Madeleine McCann in depth for the past 10 years. Our members and researchers include many people with professional expertise, such as ex-police officers, lawyers, photographers, computer experts and statement analysts.
On 10 September 2007, Chief Inspector Tavares de Almeida, on behalf of the Policia Judiciara, produced an interim (‘intercalary’) report summarising the police’s case against Madeleine’s parents, Dr Gerald and Dr Kate McCann (6):
A. The conclusions in Tavares de Almeida’s report
This is an English translation of the conclusions reached by the PJ’s investigation up to and including 10 September 2007:
QUOTE
From everything that we have discovered, our files result in the following conclusions:
A. the minor Madeleine McCann died in Apartment 5A at the Ocean Club resort in Praia da Luz, on the night of 3 May 2007
B. a simulation - a staged hoax - of an abduction took place
C. in order to render the child’s death impossible before 10.00pm, a situation of checking of the McCann couple’s children while they slept was concocted
D. Dr Gerald McCann and Dr Kate McCann are involved in the concealment of the corpse of their daughter, Madeleine McCann
E. at this moment, there seems to be no strong indications that the child’s death was other than the result of a tragic accident, yet;
F. from what has been established up to now, everything indicates that the McCann couple, in self-defence, did not want to deliver up Madeleine’s corpse immediately and voluntarily, and there is a strong possibility therefore that it was moved from the initial place where she died. This situation may raise questions concerning the circumstances in which the death of the child took place.
G. Therefore, we suggest that the case files are sent to the Republic’s Prosecutor, in the Lagos legal district, for:
1) possible new questioning of the arguidos Dr Gerald and Dr Kate McCann, and
2) an evaluation of the measure of restraint to be applied in this case.
During the house search at the McCann couple’s residence, a diary style manuscript was found, already photocopied, possibly authored by Dr Kate McCann; admitting that it may contain information that may help to reach the material truth of facts.
We therefore propose that the photocopies of the said document are presented to the illustrious judge for the purpose of its apprehension (if legal), its translation and eventual collection of information to be included in the files, as necessary for the investigation.
At this date, I submit the case files for your appreciation, for you to determine whatever you may see as convenient.

The research that we have undertaken – and that of many others both here, in Portugal, and elsewhere – leads us to support all of the above conclusions in Tavares de Almeida’s report – except for one.
We noted that when the report of the Policia Judiciara was archived in July 2007, it was said that the case would be re-opened if ‘new and credible evidence’ was received by the Portuguese authorities. The case was re-opened in the PJ’s Oporto office in 2013. Our letter contains evidence which we believe they should see and act on.
As a result of painstaking research by many people, we believe that we are now in a position to supply you with new and credible evidence on one matter (the date of death) covered in the first point of Tavares de Almeida’s report, namely: “Conclusion A. the minor Madeleine McCann died in Apartment 5A at the Ocean Club resort in Praia da Luz, on the night of 3 May 2007”.
We are satisfied that we can now provide sufficient evidence to show that the minor Madeleine McCann died not on the night of Thursday 3rd May, but instead died between Sunday afternoon (29th April) and Monday afternoon (30th April).
The remainder of this letter sets out in brief summary the evidence which we suggest points clearly to Madeleine having died on the Sunday or Monday that week. We will present the evidence under these seven headings:
1. A large number of false statements were made at the outset, containing a huge amount of fabricated evidence. These added credibility to the McCanns’ claim that Madeleine had been abducted on Thursday 3 May. They diverted the PJ investigation into believing that Madeleine was still alive that day.
2. The photograph of Madeleine McCann, Dr Gerry McCann and Amelie, taken by the Ocean Club pool.
3. The absence of photographs of Madeleine taken after Sunday. (7)
4. The fabricated statement of Nuno Lourenco, who tried to identify Wojchiech Krokowski as a potential child-kidnapper who had tried to abduct his daughter on Sagres beach. (3) (8) (9) (10) (11)
5. The unreliable evidence of the children’s nanny (and McCann family friend), Catriona Baker, Dr Gerry McCann and Dr Kate McCann about an alleged ‘high tea’ at the Ocean Club Tapas restaurant, at about 5pm to 6pm on Thursday 3 May. (12)
6. The lack of any credible, independent evidence by anybody that Madeleine McCann was seen alive after Sunday 29th April. (7) (13)
7. The mystery of the strange ‘Make-Up Photo’ of Madeleine, which appears to have been taken on Sunday 29th April, (5) (14) (15) and
8. Clear photographic evidence that the very same pyjamas Madeleine had with her on holiday in Praia da Luz were later held up by the McCanns at two press conferences, one in London on 5th June 2007, the other in Amsterdam, Holland, on 7th June 2007. (16) (17)
In presenting our evidence, we wish to emphasise that we are in no way critical of the PJ investigation. On the contrary, we believe it was diligently and brilliantly pursued in almost impossible circumstances, namely the determination of the British government and media to insist that Madeleine had been abducted. It is our case that the abduction hoax was skillfully crafted over a period of four days, and was so designed as to deliberately mislead the PJ. Only after years of patiently unravelling the evidence and exposing the deceit has it been possible to arrive at our conclusion that Madeleine was probably dead 3 to 4 days before Thursday 3 May.
Before detailing our evidence on these points, we would like to make the following observations on the conclusions of Tavares de Almeida and of Dr Gonçalo Amaral in his book, A Verdada da Mentira, ‘The Truth of the Lie’. (18)
B. The PJ’s evidence about the alleged ‘high tea’ with Madeleine and her parents on the afternoon of Thursday 3 May
In Tavares de Almeida’s report (6), he states the following about the events of the evening of Thursday 3 May:

“But there is another question about the timing which is this: The last time that the child was seen outside of the group, by someone who can prove they saw her, was at around 5.35pm, when the parents went to pick her up at the crèche.
“This may widen the time lapse between Madeleine’s ‘disappearance’ and the alarm being raised into more than four hours”.

This is paralleled by two short passages in Goncalo Amaral’s book ‘The Truth of the Lie’. Here is an English translation (by Anna Silvestro) of the relevant paragraphs (18):

(1st passage) “On the fateful day of May 3rd, the attendance register at the play centre indicates that Madeleine arrived at 9.10, accompanied by her father. Her mother came to fetch her at 12.25 for lunch and took her back at 2 o'clock. After jogging on the beach and going to fetch the twins, she collected Maddie at 5.30pm. From that moment on, no other person saw the little girl, apart from her parents and their friends. What happened then in the apartment remains a mystery”.
(2nd passage) “THE INTERROGATIONS
“We finally decide to question [Kate McCann[ as a witness, but not to pose questions on the events after 5.30pm, the time at which she returned to the apartment with her three children.
A DISAPPEARANCE, A WINDOW AND A BODY
“It is now important to present a summary of this case, based on our deductions: reject what is false, throw out what we can't show with sufficient certainty and validate that which can be proven. Point 5. The body, the existence of which has been confirmed by the EVRD and CSI dogs, but also by the results of the preliminary laboratory analyses, cannot be found. The conclusions my team and I have arrived at are the following:
1. The minor, Madeleine McCann died inside apartment 5A of the Ocean Club in Vila da Luz, on the night of May 3rd 2007;
2. Kate Healy and Gerald McCann were probably involved in the concealment of their daughter's body.
3. The death may have occurred as a result of a tragic accident…”

We will present evidence that Madeleine was not present at that ‘high tea’, (4) (13) that the ‘high tea’ never happened, and that there is no credible, independent evidence that Madeleine was seen alive after lunchtime on Sunday 29th April. (4) (13)
C. The two descriptions of an abductor by Jane Tanner and Nuno Lourenco
We will also make observations on another matter. That is the descriptions given of an abductor to the PJ by the McCanns’ friend, Jane Tanner, during Friday, 4th May, and a second description of a child kidnapper by Nuno Lourenco, early the following day (Saturday 5th November).
This is what Tavares de Almeida says about the claims of Jane Tanner (6):

“Later, during the course of the morning of May 4th, the father gives the same brief description [as Jane Tanner did] and refers back to Jane for additional details. The latter [Jane tanner] appears at the offices of the Policia Judiciara in Portimão at 11.30am. This time, the description is very precise:
- the individual, aged between 35 and 40, was thin and 1.70m tall;
- his hair was dark brown, falling over his collar;
- he was wearing cream or beige trousers, probably linen,
- a sort of anorak - but not very thick –
- and black shoes, classic in style.
He was walking hurriedly, with a child in his arms. He was warmly dressed, the reason she thought he was not a tourist. The child appeared to be asleep - she only saw the legs - had bare feet and was dressed in pyjamas, which were obviously cotton, light-coloured, probably white or pale pink, with a pattern - flowers maybe, but she isn't certain. Concerning the man, she states that she would recognise him from the back by his particular way of walking. The importance of this statement will be seen later”.

Now we come to a description of a man given by Nuno Lourenco to the PJ on the morning of Saturday 5th May (8) (9) (10). He said this man tried to kidnap his daughter outside a café in the village of Sagres, on Sunday 30th April (8). As we now know from the PJ’s investigations during that Saturday, they identified the man as Wojchiech Krokowski, (9) (10) (18) a Polish man who was on holiday in Praia da Luz in the very same week that the McCanns were also staying there. This is what Gonçalo Amaral says in his book about Nuno Lourenco’s claims (18):

“From information from Sagres, we learn that an individual has been surprised on Mareta beach taking photos of several children and in particular of a little girl aged 4, blonde with blue eyes, who looks like Madeleine. It was the little girl's father who noticed him. This 40 year-old man, wearing glasses, tells the investigators that the photographer tried to kidnap his daughter in the afternoon of April 26th in Sagres.
“He allegedly then fled in a hired car with a woman in the passenger seat. The stranger did not look like a tourist; brown hair down to his collar, wearing cream-coloured trousers and jacket and shoes of a classic style. This report reminds us of the individual encountered by Jane Tanner in the streets of Vila da Luz on the evening of Madeleine's disappearance.
“Thanks to the father's composure, he managed to take a photograph of the vehicle. It's not very clear and does not allow us to make out the number plate, but we succeed, nonetheless, in finding the car. The car hire firm provides us with the identity of the driver. He is a forty-year-old Polish man, who is traveling with his wife. They arrived in Portugal on April 28th, from Berlin. At Faro airport, they hired a car and were put up in an apartment in Budens, near Praia da Luz. Unfortunately, on May 5th, at 7am, they had already left, taking with them their camera and all the photos from their holiday. We ask the German police, through Interpol, to monitor them as soon as they arrive in Berlin. All the passengers are questioned, but no one has seen a child looking like Madeleine. In Berlin, the couple take the train to return to Poland. Thus, the Polish trail comes to an end. We would like to have seen their photos...but that proved impossible”.

As can be clearly seen, Gonçalo Amaral and his team of PJ detectives clearly believed that the man seen by Nuno Lourenco at Sagres on Sunday 30th April was the same man that Jane Tanner had seen at around 9.15pm on Thursday 3rd May (19) (20)near the McCanns’ apartment. All the following descriptions were identical:
- age of the man (35-40, or 40)
- hair brown or dark brown
- hair ‘down to’ or ‘falling over’ his collar
- cream-coloured trousers
- ‘jacket’ or ‘anorak’
- -shoes of a classic style
- “didn’t look like a tourist” (because of wearing ‘warm clothes’).
In this letter we will present evidence that:
• Nuno Lourenco’s statement was a complete fabrication
• Jane Tanner’s statement was also a complete fabrication
• The descriptions given were so similar that they provide the strongest possible evidence that they were planned well before Thursday, and
• There was collusion between Jane Tanner, Nuno Lourenco and others to fake the existence of an abductor (3) (9) (10).
D. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 1. A large number of false statements were made at the outset, containing a huge amount of fabricated evidence. These added credibility to the McCanns’ claim that Madeleine had been abducted on Thursday 3 May. They diverted the PJ investigation into believing that Madeleine was still alive that day.
As the PJ concluded, we agree that a hoax abduction was ‘staged’. We also agree that the furniture in the McCanns’ apartment was pre-arranged on Thursday 3 May to fake an abduction scenario. All this needed the co-operation of the McCanns and all of their Tapas 7 friends.
We also entirely agree with the PJ’s evidence (see Tavares de Almeida’s report) that there were:
a) multiple contradictions between the evidence of the witnesses
b) multiple changes of story by the chief witnesses, and
c) that the McCanns would adapt their narrative as new embarrassing facts emerged.
In fact much more evidence of these contradictions and changes of story has emerged since Gonçalo Amaral was removed from the PJ investigation on 2 October 2007. To take one example from Gonçalo Amaral’s book; he correctly identified that the accounts of Dr David Payne visiting Kate McCann in Apartment 5A were contradictory. We have since discovered a total of at least 20 contradictions as between their two versions of what happened. (21) We hold that this is more than sufficient to prove that the alleged ‘visit’ was fabricated.
Three individuals in particular led the PJ investigation and Gonçalo Amaral to conclude that Madeleine must have died after 5.30pm on Thursday 3 May: Jane Tanner, Nuno Lourenco and Catriona Baker, the children’s nanny.
We deal with the evidence of Nuno Lourenco and Catriona Baker below. Here we summarise why the evidence of Jane Tanner should be treated as wholly unreliable – as the PJ team itself soon recognised:
1. She and her husband Russell O’Brien were close friends of the McCanns. That means she is not an independent witness
2. On Sunday 13 May she was adamant that the man she claimed to have seen, carrying a bundle or a child, at around 9.15pm on Thursday 3 May, was Robert Murat. This identification of him by Jane Tanner was a major reason why Murat was pulled in for questioning two days later (18)
3. It has since become clear that in the hours before she was placed in a police van by the PJ, in order to see if she could identify the man she claimed to have seen, she was spoken to by a senior Leicestershire police officer, Detective Chief Superintendent Bob Small, and two staff from the British government-funded security agency, Control Risks Group (22). It is reasonable to suspect that these three people influenced Jane Tanner to make a false claim that she ‘recognised’ Robert Murat
4. In his book on the case, Goncalo Amaral refers to the sudden arrival in Portugal of large numbers of British government, police and security personnel – staff from the Foreign Office, the British Embassy, Leicestershire Police, Scotland Yard, MI5, Special Branch, the National Police Improvement Agency, CEOP and Control Risks Group. Amaral records in his book the following (18):

“FOR THE PROFILERS, MURAT IS THE GUILTY PARTY
“Since Murat's first interview, which they attended, the specialists have continued to refine the profile of the suspect [Robert Murat]…according to the English profilers, there is a 90% chance that he is the guilty party…”

5. From all the above, we say there is clear evidence of a plot to ‘frame’ Robert Murat and persuade the PJ to question him and make him a formal suspect, an ‘arguido’. And this is exactly what happened on Tuesday 15 May (18).
6. In October 2007, the McCann Team released an artist’s sketch of the man said to have been seen by Jane Tanner. It was drawn up by a ‘forensic artist’, Melissa Little. She was employed by Cheshire businessman, Brian Kennedy, who directed the McCann Team’s highly controversial private investigation. The sketch did not look like Robert Murat.
7. Later, in January 2008, there was a major news story in the British press about a man with ‘straggly hair’ and a moustache, said by both the McCann Team and Leicestershire Police to be a new ‘chief suspect’. (20) (21) (22) (23) The McCanns’ PR agent, Clarence Mitchell (who at the time of Madeleine’s disappearance was the head of the British government’s Media Monitoring Unit), held a special ‘police-style press conference’ to promote this new suspect. Once again, Melissa Little drew the artist’s sketch that was presented to the media. In some respects, the sketch resembled the earlier sketch drawn up by Jane Tanner. Jane Tanner was quoted in the British press as saying she was ‘80% sure’ that the man she said she had seen on 3 May was the same as the man with the straggly hair and the moustache. This was despite the facts that (a) she frankly admitted that she had never seen the face of the man on 3 May and (b) the man with the straggly hair and the moustache looked nothing like Robert Murat.
8. Also in January 2008, Jane Tanner admitted that she was ‘no longer sure’ that the man she had seen on 3 May was Robert Murat (29) (30) (31).
9. This admission was important because, in the two days after Robert Murat was made a formal suspect, three friends of the McCanns (Fiona Payne, Russell O’Brien and Rachael Oldfield) all made statements to the PJ claiming that they had seen Robert Murat near the McCanns’ apartment on the night of 3 May. Yet eight months later (January 2008), they admitted that they might have been ‘mistaken’. (18)
10. One more indication that Jane Tanner’s claims were false came in a press conference held by the McCann Team in August 2009 (28). This conference was held in order to promote the McCanns’ latest theory, that Madeleine had been abducted by a woman, on a yacht bound from Barcelona to Australia. In order to promote this theory, the McCanns’ latest chief private investigator, former Detective Sergeant, Dave Edgar, said that Jane Tanner might have been mistaken and that she saw a female carrying a child, not a male.
11. Finally, we add that on 14 October 2013, around 7 million people in Britain watched a TV programme about Madeleine’s disappearance, made by the BBC together with the Metropolitan Police (27). They had together spent over £2 million making this film. In the film, the Metropolitan Police chief investigator, Detective Chief Inspector Andy Redwood, said that the man seen by Jane Tanner had ‘come forward’. He told us that the man’s daughter had been in the ‘night creche’ on 3 May and that he had carried his daughter, clad only in her pyjamas, back to wherever he was staying that night.
12. There were many reasons to doubt DCI Redwood’s claims (27), for example:
(a) why had this man kept silent for 6 years?
(b) if the man had been walking past the McCanns’ apartment that night from the crèche, maps showed that he was not taking the direct route from the crèche but must have gone a longer way around
(c) we were not given the identity of the man; only a blurred photograph, said to be of this man, was shown
(d) we were told that (i) he had been wearing exactly the same sort of clothes on holiday as those described by Jane Tanner (ii) his daughter had been wearing very similar pyjamas to those worn by Madeleine on that holiday and (iii) that he had for some unknown reason kept these very pyjamas for 6 years
(e) there is no explanation of (i) where the mother of this child was whilst the man was carrying her home in the dark on a cold evening (only 13 deg C) (ii) why he was not using a buggy and (iii) why his daughter was only in pyjamas, with no covering over her.
In short, none of the dozens of serious Madeleine McCann researchers in Britain believes that DCI Redwood was telling the truth. We believe it was yet another lie by the British police to continue the claim that Madeleine was abducted, when she was not.
E. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 2. The photograph of Madeleine McCann, Dr Gerry McCann and Amelie, taken by the Ocean Club pool
One of the most famous photographs of Madeleine is one of her, her sister Amelie, and her father Dr Gerry McCann, sitting by the Ocean Club pool. They said that this photograph was taken by her mother, Dr Kate McCann, on the last day of their holiday, Thursday 3rd May, at about 2.29pm.
We will present a summary of evidence below which suggests that this was a deliberate lie by the McCanns and by those supporting them (4) (32) (33) (34) . We will show that this photograph was almost certainly taken on Sunday, 29th April at lunch-time. (4) (33) We will also show that this was the last photograph of Madeleine ever taken, with the possible exception of what we will call the ‘Make-Up Photo’ - see below (14) (15). Further, we will show that there is no credible, truly independent evidence that Madeleine was alive after the afternoon of Sunday 29th April (13). From these conclusions we will also suggest that it is unlikely that Madeleine’s death was ‘accidental’ (as suggested in the PJ’s report) and we will also suggest that Madeleine’s parents had professional help from the highest levels of the British government in order to ‘stage’ an abduction (the PJ’s own conclusion) and to help keep up the ‘myth’ of Madeleine being abducted for over 10 years (2) (4) (5).
The specific evidence relating to the ‘Last Photo’ is as follows:
1. The photograph is said to have been taken by Kate McCann. Two acknowledged experts in digital photography have examined this photograph in detail and both, independently, agreed that it was a genuine photograph with no signs of alteration or ‘photoshopping’ (33)
2. The experts also pointed out, however, that it was a relatively simple matter to change the date and time stamp, to try to prove that a photograph was taken on a different date from the actual date (33)
3. On 9 May, Dr Gerry McCann and a close relative, Michael Wright, presented to the PJ two computer disks which purported to show all the photos taken on the holiday by the McCanns and their friends, the Paynes. These disks included three photographs of Madeleine happily playing in the Ocean Club playground on the first day of the holiday (Saturday 28th April). But for reasons which have not been explained by the McCanns, these two disks did not include the ‘Last Photo’. (4)
4. Furthermore, it is clear from the PJ files that the two computer disks of photos were compiled with the additional help of Alex Woolfall, the Head of Risk, employed by the huge PR firm, Bell Pottinger. He has admitted this. It is unclear why the ‘Head of Risk’ at a major public relations firm should need to sort through the McCanns’ holiday photographs (4) (33) [NOTE: We add here the following information: 1. Sir Tim Bell, former Chairman of Bell Pottinger, admitted that the McCanns paid him over £600,000 to ‘keep their name on the newspaper front pages for a year’, and 2. This year, Bell Pottinger collapsed, and is now ‘in administration’, following revelations about a campaign of lies they conducted in South Africa to back up the discredited President, Jacob Zuma. The firm, and those who run it, have been totally discredited. Bell Pottinger also received huge payments from various corrupt regimes and individuals they worked for in different parts of the world]
5. The weather when the photo was taken This is a crucial evidential point that the PJ had no opportunity to consider. At lunch-time on Thursday 3 May, the weather was cloudy and cool (17 deg C). This can be demonstrated from assorted weather records and photographs. By contrast, the weather on Sunday lunchtime (29th April) was sunny and very warm (21 deg C). By Monday, a cold front had already brought cooler and cloudier weather with some rain. This lasted until Friday (4) (33).
6. Now we need to look at the evidence of the photo itself. This is what we observe:
(a) bright sunshine
(b) no evidence of any wind
(c) three people sitting by the pool, dipping their feet in the pool
(d) Dr Gerry McCann wearing T-shirt and shorts
(e) Madeleine and Amelia wearing light clothing
(f) Madeleine and Amelie both wearing sun-hats
(g) a sheen of perspiration on Gerry McCann’s forehead
(h) Gerry McCann wearing sunglasses (4) (33).
None of these features match the claim that this photograph was taken on Thursday 3rd May. They all match, however, with the only sunny and warm day of the holiday: Sunday 29th April.
7. The photograph was not produced by the McCanns until Thursday 24 May. Why, when it was already in the McCanns’ camera, was it not produced straightaway, when the police and the press required the most up-to-date photo of Madeleine?
F. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 3. The absence of photographs of Madeleine taken after Sunday.
Only five photographs of Madeleine on that holiday are claimed to exist.
We have mentioned four of them:
(a) There were three photographs of Madeleine taken on the Saturday. Dr Gerry McCann handed these to the PJ on 9 May 2007
(b) There is the ‘Last Photo’, which the McCanns say was taken on Thursday 3rd May. However, we have shown that it must have been taken on Sunday 29th April.
That leaves just one other photo which the McCanns claim was taken on that holiday: the so-called ‘Tennis Balls Photo’, which purports to show Madeleine clutching some tennis balls.
There are numerous problems with this photo (35) (36 (37). The main four are:
(1) Two different people are said to have taken it (Kate McCann and Jane Tanner)
(2) They claim they were taken on two different days (Tuesday and Thursday), and
(3) The improbability of Kate McCann’s account (in her 2011 book, ‘madeleine’) of how the photograph came to be taken (she writes of how she ran back to her apartment to get her camera, while Madeleine was apparently there, waiting for this photograph to be taken
(4) The photograph appears inconsistent with what is said by Kate McCann. There are no other children in shot. There are no children’s nannies or tennis coaches in shot, the balls that the girl in the photo is holding are adult balls, not the soft balls that children would use when playing mini-tennis.
Furthermore, there is no independent witness (such as a crèche nanny or tennis coach) of how and when this photograph is supposed to have been taken.
In addition, some observers have noted that whilst the head of the girl in the photograph is clearly that of Madeleine, the body of the girl looks different from Madeleine in a number of ways. Notably the girls’ legs look sturdier, as if they are of an older girl, and her arms and legs have a number of marks, possibly bruises and scratches, and look red and sunburnt when compared with the pale skin of Madeleine, as seen on the three photographs of Madeleine on Saturday, and the ‘Last Photo’ which we are sure was taken on the Sunday. (4) (35) (36) (37)
Therefore we have no proof of any photograph of Madeleine being taken on the Monday, Tuesday, Wednesday or Thursday that week. That is wholly consistent with our case that Madeleine died on the Sunday.
We should add that a Mr Philip Edmonds, a Director of Stemcor, the international steel company, was on holiday that week with his three sons, and claimed to have taken a photograph of his three sons playing in the Ocean Club playground, on Thursday 3rd May, showing Madeleine McCann in the background. He further claimed publicly that he had sent this photograph to the PJ. However, no such photograph appears in the PJ files, not has it been published elsewhere. There is every reason to doubt whether – even if he has supplied such a photograph – that it could prove that Madeleine was alive that day (38).
G. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 4. The fabricated statement of Nuno Lourenco, who tried to identify Wojchiech Krokowski as a potential child-kidnapper who had tried to abduct his daughter on Sagres beach.
Nuno Lourenco claimed he was living in Germany but had been over to Sagres for a short holiday to see his mother, who still lives in the area. (8)
Early on Saturday 5th May, he contacted the PJ to say that a man had been photographing children (including his own) on Sagres beach during the afternoon of Sunday 29th April (although Goncalo Amaral gives a different date for this in his book). (8) (18)
Nuno Lourenco provided a photograph in support of his claims. He said that he had managed to take a photograph of the man on his mobile ’phone before he drove away. He also gave the police the last four digits of the car registration number of the vehicle. (8)
With this information, the Portuguese police were able to establish that the owner of the car was a car rental agency based in Burgau, and that the car had been rented for the week by a Mr Wojchiech Krokowski. Krokowski and his wife had been holidaying at an apartment in the Sol e Mar building in Burgau. The police later established further details about Krokowski and his wife from the owner or manager of the Burgau Beach Bar (believed to be Mr Ralph Eveleigh or his manager), a CCTV in a shop in Lisbon, and the Polish Police. (8) (18)
It is clear from what we said in our introduction that Gonçalo Amaral and his PJ team believed that Nuno Lourenco had identified the same man as seen by Jane Tanner. (18)
If we now compare the descriptions by Jane Tanner (of the man she said she saw) and by Nuno Lourenco (of the man we now know to have been Wojchiech Krokowski), the similarities are astonishing, as we now set out in this table:

We make these observations on Nuno Lourenco’s statement (3):
1. The account he gives of the attempted kidnap lacks credibility in several respects:
(a) why would a holidaymaker, with his car apparently parked some way away outside the village, attempt (in broad daylight) to kidnap a child?
(b) why are there no other witnesses to this incident?
(c) his account of how he tried to take a photo of Krokowski, but failed because his finger was blocking the viewfinder, also lacks credibility
(d) his account of what actually happened inside and outside the café also does not have the ‘ring of truth’ about it
(e) he did not report what (if true) must have been a frightening incident to the police until six days later
(f) he laid great emphasis on how the date and time stamp on his mobile ’phone ‘proved’ that the photograph of Krokowski’s car was taken around 6pm on Sunday 29th April. This reminds us of another photograph, the ‘Last Photo’, was said to have been taken on Thursday 3 May, according to the date stamp, yet evidence suggests that it was taken four days earlier. We suggest that it is likely in all the circumstances that Lourenco took this photograph later in the week, but date-stamped it to fool the PJ team into thinking it was taken on the Sunday
(g) he did not ’phone the police until six days later, and waited until after Jane Tanner had given her statement to the police
(h) moreover, he waited until around the time that the plane taking Krokowski and his wife back to Poland was taking off from faro Airport. This seems to us like more than a coincidence (9) (10).
Taking all these matters into account, and having regard also to the astonishing coincidences between the descriptions given by Jane Tanner (of the man) and Nuno Lourenco (of Wojchiech Krokowski), we arrive at these very disturbing conclusions:
1) Jane Tanner and Nuno Lourenco were describing the same man – Wojchiech Krokowski
2) The description must therefore have been based on Wojchiech Krokowski and what he was wearing that week
3) Either Jane Tanner and Nuno Lourenco must have colluded in order to give police identical descriptions, OR at least one third party must have planned this collusion, and given them instructions on what to say to the police (3).
This means that Jane Tanner, Nuno Lourenco, and any or all people who colluded in deceiving the police in this way have committed the offence (in English law) of perverting the course of justice. In English law this offence attracts the maximum penalty of 14 years.
[ NOTE: We add here the strange matter of the evidence of three members of the Smith family, who claimed to have seen a man carrying a girl dressed only in pyjamas at about 10.00pm on Thursday 3 May. What is astonishing is that when they travelled to Portugal to give their statements on 26 May, they also gave an almost identical description of the man they claimed they saw to those given by Jane Tanner and Nuno Lourenco.
The Smiths also described a man ‘about 35-40’, ‘wearing cloth clothes’, ‘wearing classic shoes’, and who ‘didn’t look like a tourist’. The girl he was carrying was also dressed only in white/pink pyjamas.
If we are correct in asserting that Madeleine was probably dead on Sunday, then what possible explanation can there be for him reporting seeing someone, at about 10.00pm on Thursday 3rd May, identical to the descriptions of a man given by Jane Tanner and Nuno Lourenco?
It raises a realistic possibility that this was also a fabrication, and that Martin Smith and his family were also using the same description of Wojchiech Krokowski.
We may add that on 20th September 2007, nine days after seeing TV footage of Gerry McCann carrying his son Sean down the steps of an aeroplane, Martin Smith claimed (with 60% to 80% certainty] that the man he said he had seen on 3rd May was Gerry McCann. Yet despite that, he admits to having been contacted by Mr Brian Kennedy, head of the McCanns’ private investigation, in December 2007, and since then has clearly been working with the McCanns, making public statements sympathising with the McCanns and urging the public to ‘look for the abductor’ ]. (3)
H. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 5. The unreliable evidence of the children’s nanny, Catriona Baker, Dr Gerry McCann and Dr Kate McCann about an alleged ‘high tea’ at the Ocean Club Tapas restaurant, at about 5pm to 6pm on Thursday 3 May.
The crucial evidence that Madeleine was still alive at 5.30pm on Thursday 3rd May came from one of the nannies, Catriona Baker (39) (40) (41). She was also the crèche nanny for Madeleine’s daytime group, the ‘Lobsters’. Both Tavares de Almeida and Gonçalo Amaral in his book were certain that she was telling the truth, and that, because she was thought to be an ‘independent’ witness, they could rely on her word (18).
Detailed investigation, however, has uncovered a mass of contradictions as between the four main witnesses who gave evidence about this alleged ‘high tea’ on the Thursday afternoon: Dr Gerry McCann, Kate McCann, and crèche nannies Catriona Baker and Charlotte Pennington (12). These contradictions have been analysed by many Madeleine researchers. All have come to the conclusion that the contradictions are so many and so serious that it is highly doubtful that this ‘high tea’ happened at all. It is simply not possible to accept Catriona Baker as a witness of truth.
Furthermore, research has uncovered the fact that Catriona Baker probably knew the McCanns before this holiday (4).
Records on the social media group Facebook show that Catriona Baker was, in 2006 and possible before then, a Facebook friend of Chloe Corner. Chloe Corner is the daughter of Madeleine’s godfather, Jon Corner. Jon Corner was highly involved in events after Madeleine was reported missing. Within hours, he was seemingly able to send unlimited photos of Madeleine to the media, from his home in Liverpool. In addition, Jon Corner said he had been to Praia da Luz several times previously, suggesting a connection with the village. Jon Corner also lived with the McCanns for around a week in August 2007, during which time he took them to Huelva to distribute leaflets about Madeleine. He made a film about Madeleine which was later used by Panorama for their programme about Madeleine shown on 19 November 2017 (4).
In November 2007, six months after Madeleine was reported missing, Catriona Baker visited the McCanns in Rothley, staying with them for a number of days. There are also indications from Kate McCann’s account of Catriona Baker in her book, ‘madeleine’, that she may have known her already, although she does not admit to this (4).
These connections of Catriona Baker to Jon Corner and the McCanns were not known to the PJ team nor to Gonçalo Amaral. If they had been, they would certainly not have been so ready to regard her as an ‘independent’ witness.
I. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 6. The lack of any credible, independent evidence by anybody that Madeleine McCann was seen alive after Sunday 29th April.
We have said that Madeleine was seen alive on Sunday 29th April at lunch-time. We have given evidence that we cannot rely on the claims by Catriona Baker and the McCanns that Madeleine was alive at an alleged ‘high tea’ on Thursday afternoon. (Charlotte Pennington later gave a statement about this alleged ‘high tea’ but that also contradicted the other three statements).
All other claims by witnesses who claim to have seen Madeleine after Sunday have been examined in detail by a British ex-pat now living in Canada, Lizzy Taylor (13). She concluded that apart from the evidence given by the McCanns and their Tapas 7 friends - which of course is not independent – all other statements claiming to have seen her were open to serious doubt. Many were extremely vague, with no checkable details given. Others were plainly wrong, for example, witnesses claiming to have seen Madeleine eating breakfast with the McCanns in the Millennium when the McCanns in their statements have consistently said they ate breakfast in their apartment every day from Monday onwards.
The absence of any other reliable witness to seeing Madeleine from Monday onwards is disturbing, and strongly tends to confirm that Madeleine was not alive after Sunday.
J. EVIDENCE OF DEATH ON SUNDAY OR MONDAY – 7. The mystery of the strange ‘Make-Up Photo’ of Madeleine, which appears to have been taken on Sunday 29th April.
The ‘Make-Up Photo’ was first published in a short, 2-minute video made by Madeleine’s godfather, Jon Corner. It shows Madeleine with a great deal of make-up, namely:
- a necklace
- a hair bead
- lipstick
- eye shadow, and
- eye liner.
It must also be said that Madeleine has very dilated (large) pupils in the photo, and there is no sign whatsoever of any happiness or joy. Rather, she looks deeply sad. Many observers have understandably called it a ‘Lolita’ photograph (42).
When this photo was published, it attracted much negative comment, including in one British broadsheet newspaper, the Independent. A prominent criminologist, Mark Williams-Thomas, also criticized the McCanns for releasing this photograph (although it is by no means certain that the McCanns gave permission for this photograph to be published) (42).
The McCanns claimed that the Make-Up Photo showed Madeleine ‘playing with Mummy’s make-up box’ and told the media that the picture was taken ‘a few weeks before’ their Praia da Luz holiday (42).
Many Madeleine researchers who have studied this photograph carefully have made these observations about it (14) (15):
1) Madeleine could not have applied the eyeliner herself. She could not have applied either the lipstick or the blue eye-shadow neatly. She certainly could not have put on her necklace herself, nor her hair bead. An adult must have done all this, but we have not been told who did it. Therefore the McCanns have not been truthful about the circumstances in which this photograph was taken. That means we are entitled to ask serious questions about when, where and why it was taken.
2) In the photo, we see Madeleine’s pupils dilated (enlarged)
3) Madeleine displays no signs of fun, joy or happiness in this photo, as you would expect if she was having fun playing with Mummy’s make-up box. On the contrary, there seems to be a look of sadness, or even fear or dread in her eyes.
4) The photo is taken against a stucco background, either cream, yellow or ochre in colour. This is most unlike houses built in England. However, it strongly resembles the outdoor cladding of many buildings along the Algarve coast in Portugal.
5) Madeleine’s appearance in the Make Up Photo is strikingly similar to how she looks in the ‘Last Photo’, which we assert was taken on the Sunday. In both photos:
(a) Madeleine’s hair length, style and colour is identical
(b) in both, she is wearing a hair bead (although in different positions), and
(c) in both, she can be seen wearing a pink-coloured smock, top or dress.
Especially given what we have said in point (5) above, we are entitled to ask whether this photo could have been taken on the McCanns’ holiday in Praia da Luz, possibly even on the very same day as the Last Photo – Sunday, 29th April.
K. Clear photographic evidence that the very same pyjamas Madeleine had with her on holiday in Praia da Luz were later held up by the McCanns at two press conferences, one in London on 5th June 2007, the other in Amsterdam, Holland, on 7th June 2007.

In summary, the film by Hall and the article by Dr Roberts reveal the following:
1. Madeleine’s pyjamas were photographed by the McCanns before they raised the alarm about Madeleine being missing at about 10.00pm on 3 May
2. Very clear photographic evidence (and other accompanying evidence) proves that the identical pair of pyjamas were personally displayed by the McCanns at two press conferences, one in London on 5th June 2007, the other in Amsterdam, Holland, on 7th June 2007.
It follows from these two facts that the entire claim by the McCanns that Madeleine was abducted - in her pyjamas, between 9.15pm and 10.00pm - is false. Madeleine must therefore have disappeared under entirely different circumstances. As Dr Roberts out it in his article: “If Madeleine’s pyjamas were not abducted, then neither was Madeleine”.
OBJECTIONS TO OUR THEORY
A number of objections have been raised to our hypothesis. We list them here and give brief answers:
1 ‘It would be impossible for so many people to lie about the death of a missing girl and take part in a cover-up’
2 ‘No-one would dare to stage a hoax abduction after their child had been dead 3-4 days’
3 ‘The McCanns and their friends could not have all agreed to cover up a child’s death’
3 ‘It is impossible to believe that Catriona Baker, Madeleine’s crèche nanny, could help to forge the crèche records and lie about Madeleine not being in the crèche from Monday onwards’
4 ‘Mrs Fenn heard Madeleine crying for her Daddy between 10.30pm and 11.45pm on Tuesday 1 May’.
In reply, we make the following points.
So far as Mrs Fenn’s evidence is concerned, there are several major problems about it:
(a) she did not make statements about having heard Madeleine crying until 20th August, over 3½ months after Tuesday 1st May (4) (43)
(b) neither did she make statements about an alleged break-in at her flat until 20th August (4) (44)
(c) a review of all the statements she made about the alleged burglary reveals major contradictions e.g. about when the burglary was supposed to have happened, what actually happened inside her flat, how the intruder escaped, and who else was there at the time (44)
(d) the evidence she gave was leaked in advance and was published in the British press on 18 & 19 August i.e. before she gave her statement, suggesting that she colluded with others in giving her evidence (4) (43) (44)
(e) she claims to have heard Madeleine crying ever more loudly for 75 minutes – but no-one else in the apartment bloc heard this
(f) she contrived her statement to say that the crying was that of a child ‘more than two years old’ – but it is not possible to make such a clear distinction between the crying of a three-year-old and a two-year old
(g) she did not seek any help in alerting anyone else to the crying she said she heard, except an alleged telephone call to a Mrs Edna Glyn, which as far as we know from the PJ files the Portuguese police were unable to verify, and
(h) she herself told the media to ignore all that had been said in the newspapers about her evidence.

In response to the other points above, we simply do not know how Madeleine died, especially now that it seems certain that she died on the Sunday or possibly Monday. It is possible, in fact we say probable, that she may have died under circumstances where the McCanns and their friends felt there was serious risk for them if Madeleine’s body was to be produced for an autopsy. At this point we mention the sexually suggestive remarks made by Dr David Payne about Madeleine, as reported on 19th May 2007 by Dr Arul and Dr Katarina Gaspar. We also think it is relevant to point out that the Gaspars’ two statements were not forwarded to the PJ until three weeks after Gonçalo Amaral had been removed from the case.
It has been suggested that Madeleine’s death could not have been covered up because far too many people must have been involved. In reply, we suggest that only a handful of people would be needed to keep Madeleine’s death a secret. By Sunday night, Madeleine would not be known by many people except the McCanns, their ‘Tapas 7’ friends and Catriona Baker, Madeleine’s crèche nanny (who, as we have evidenced, seems to have been a friend of the McCann family already). Possibly the Ocean Club Manager and someone from Mark Warner may have been informed and a collective decision made to keep Madeleine’s death a secret and plan a hoax abduction (45) (46) (47).
If Madeleine’s death was the result of any criminality, that would be a powerful reason for those involved to cover up what had happened. A cover-up and hoax abduction could then have been carried out in total secrecy.
The facts point to death on Sunday, or Monday at the latest.
This, we suggest, opens up a vital new line of enquiry. This, we suggest, must be the starting-point for a fresh Portuguese police investigation.
We conclude by suggesting what we think must be obvious by now to the Portuguese authorities: namely that the Metropolitan Police investigation into Madeleine’s death, Operation Grange, has clearly never been a genuine attempt by the British police to get to the truth of what really happened to Madeleine.
We add many references below and would be willing to assist the Portuguese judicial and police authorities in any further way that we can.

Assunto: O Desaparecimento de Madeleine McCann: Novas provas sobre o que aconteceu
Somos um grupo de investigadores, na sua maioria britânicos, que tem tem vindo a analisar e estudar o desaparecimento de Madeleine McCann, durante os últimos dez anos. Os investigadores e membros deste grupo incluem muitos especialistas em diversas áreas, tais como ex-polícias, advogados, fotógrafos, técnicos de informática e analistas de informação.
A 10 de Setembro de 2007, o inspector-chefe da Polícia Judiciária Tavares de Almeida elaborou um relatório intercalar, sintetizando as acusações da polícia contra os pais de Madeleine, Dr. Gerald e Dra. Kate McCann (6).
A. As conclusões do relatório do inspector Tavares de Almeida
Conclusões a que a PJ chegou, na sua investigação, até ao dia 10 de Setembro de 2007, inclusive:
CITAÇÃO:
Por todo o exposto, RESULTA dos Autos QUE:
A) a menor Madeleine McCann morreu no apartamento 5 A do Ocean Club da Praia da Luz, na noite de 03 de Maio de 2007;
B) ocorreu uma simulação de rapto;
C) de forma a impossibilitar a morte da menor antes das 22H00, foi inventada uma situação de vigilância das crianças do casal McCann enquanto dormiam;
D) Kate McCann e Gerald McCann estão envolvidos na ocultação do cadáver da sua filha Madeleine McCann;
E) neste momento, parece não existirem ainda fortes indícios de que a morte da menor não tenha ocorrido devido a um trágico acidente
F) do apurado até ao momento, tudo indica que o casal McCann, como autodefesa, não queira fazer a entrega de forma imediata e voluntária do cadáver, existindo uma forte probabilidade de o mesmo ter sido transladado do local inicial de deposição. Esta situação é susceptível de levantar questões quanto às circunstâncias em que ocorreu a morte da menor.

Assim, sugere-se a remessa dos Autos ao Exm.º Sr. Procurador da República, no círculo de Lagos, PARA:
G) eventual novo interrogatório dos arguidos Kate e Gerald McCann;
H) avaliar da aplicação de medida de coacção que se julgar adequada ao caso.
Tendo-se no decurso da busca domiciliária à residência do casal McCann, encontrado um manuscrito tipo diário, já fotocopiado, possivelmente de autoria de Kate McCann; admitindo-se que o mesmo possa conter elementos que permitam atingir a verdade material dos factos, PROPÕE-SE QUE:
I) as fotocópias daquele documento sejam presentes ao M.mo Juiz tendo em vista a sua apreensão, se legal, tradução e eventual recolha de elementos a carrear para os autos, por necessários à investigação.
Face a todo o exposto, nesta data, submeto os autos à vossa apreciação para que determine o que tiver por conveniente, pelo que abro:

As investigações que levámos a cabo – e também as de muitas outras pessoa, tanto aqui, em Portugal, como noutros locais – fizeram-nos chegar às mesmas conclusões do relatório de Tavares de Almeida, acima citado – excepto em relação a uma delas.
Reparámos que, quando o relatório da Polícia Judiciária foi arquivado, em Julho de 2007, foi referido que o caso seria reaberto se “novas e credíveis provas” fossem recebidas pelas autoridades portuguesas. Em 2013, foi anunciada a reabertura do csaso, por parte da Procuradoria-Geral da República.
Como resultado de uma laboriosa investigação, levada a cabo por muitas pessoas, acreditamos estar em posição de fornecer mais provas, novas e credíveis, que podem acrescentar mais-valias importantes à reabertura do caso, nomeadamente num aspecto específico (a data da morte), questão abordada no primeiro ponto do relatório de Tavares de Almeida, onde se refere, concretamente: (…) Conclusão (...) “a menor Madeleine McCann morreu no apartamento 5 A do Ocean Club da Praia da Luz, na noite de 03 de Maio de 2007;”
Apraz-nos poder agora fornecer provas suficientes para demonstrar que a menor Madeleine McCann morreu não na noite de quinta-feira, 3 de Maio, mas sim entre a tarde de domingo (29 de Abril) e a tarde de segunda-feira (30 de Abril).
A parte restante desta carta contém um breve sumário das provas que nós consideramos apontarem claramente para o facto de Madeleine ter morrido no domingo ou segunda-feira daquela semana. Nas sete alíneas seguintes apresentamos essas provas:
1. Um largo número de falsos testemunhos foram feitos, desde o princípio, contendo uma enorme quantidade de factos fabricados. Estes factos trouxeram credibilidade à alegação dos McCann de que Madeleine tinha sido raptada na quinta-feira, dia 3 de Maio. Esses mesmos factos desviaram a investigação da PJ, no sentido de criar a ideia de que Madeleine ainda estava viva naquele dia.
2. A fotografia de Madeleine McCann, do Dr. Gerry McCann e de Amelie, tirada junto à piscina do Ocean Club.
3. A inexistência de fotografias de Madeleine, tiradas depois de domingo. (7)
4. O falso testemunho de Nuno Lourenço, que tentou identificar Wojchiech Krokowski como um potencial raptor de crianças, que teria tentado raptar a sua filha, na praia de Sagres. (3) (8) (9) (10) (11)
5. O testemunho pouco fiável da ama (e amiga da família McCann), Catriona Baker, do Dr. Gerry McCann e da Dra. Kate McCann, sobre um alegado “high tea” ou "lanche ajantarado" no restaurante Tapas do Ocean Club, por volta das 5/6 horas da tarde de dia 3 de Maio. (12)
6. A ausência de qualquer testemunho credível e independente, por parte seja de quem for, de que Madeleine McCann teria sido vista viva, depois de domingo, dia 29 de Abril. (7) (13)
7. O mistério da estranha “Foto com Maquilhagem” de Madeleine, que parece ter sido tirada no domingo, 29 de Abril (5) (14 (15) e
8. Provas fotográficas claras de que o mesmo pijama que Madeleine tinha, durante as férias na Praia da Luz, foi mostrado posteriormente em duas conferências de Imprensa, uma em Londres, a 5 de Junho de 2007, outra em Amsterdão, a 7 de Junho de 2007 (16) (17)
Ao apresentar estas provas, queremos salientar que não criticamos, de forma nenhuma, a investigação da PJ. Pelo contrário, acreditamos que essa investigação foi realizada de forma diligente e brilhante, em circunstâncias quase impossíveis, nomeadamente devido à determinação do governo britânico e dos Media, em insistirem que Madeleine teria sido raptada. É nossa convicção que a a tese do rapto foi um embuste cuidadosamente preparado, num período de quatro dias, e foi destinado, deliberadamente, a induzir em erro a PJ. Só após anos a investigar pacientemente as provas e expondo o embuste nos foi possível chegar à conclusão de que Madeleine estaria, provavelmente, morta 3 ou 4 dias antes de quinta-feira, dia 3 de Maio.
Antes de entrarmos em pormenores sobre as nossas provas, em relação a estes pontos, gostaríamos de fazer as seguintes observações em relação às conclusões do relatório de Tavares de Almeida e do livro do Dr. Gonçalo Amaral, “A Verdade da Mentira” (18).
B. As provas da PJ quanto ao alegado “high tea” ou "lanche ajantarado", com Madeleine e os seus pais, na tarde do dia 3 de Maio, quinta-feira.
No relatório de Tavares de Almeida, refere-se o seguinte, sobre os acontecimentos de dia 3 de Maio, quinta-feira:
CITAÇÃO
“Há no entanto uma outra questão sobre o horário, que é: A última vez que a criança foi vista fora do GRUPO, por alguém que possa provar esse momento, foi por cerca das 17.35, horas, quando os pais a foram buscar ao infantário / creche, o que poderá aumentar o hiato de tempo, entre o desaparecimento e o alerta, para quatro horas.”

Isto corresponde a duas curtas passagens do livro “A Verdade da Mentira”, de Gonçalo Amaral (18):

(1ª passagem) “Analisando os registos dos infantários relativos ao fatídico dia de 3 de Maio de 2007, constata-se que Madeleine deu ali entrada pelas 9 h 10, entregue pelo pai, tendo saído para almoçar às 12 h 25, sendo recolhida pela mãe. No período da tarde, entrou às 14 h 00 e saiu às 17 h 30, tendo sido a mãe que a entregou e recebeu, no regresso de uma corrida na praia e após ter recolhido os gémeos pelas 17 h 25. Foi a última vez que alguém fora da família e do grupo de amigos viu Madeleine.”
(2ª pasagem) “OS INTERROGATÓRIOS”
“Decide-se começar a inquiri-la como testemunha, devendo-se parar tal inquirição quando, no relato temporal que iria fazer do dia 3 de Maio, atingisse o momento em que pelas 17 h 30, regressou ao apartamento com os três filhos (...)”
UM DESAPARECIMENTO, UMA JANELA E UM CORPO
Aqui chegados importa fazer uma síntese dedutiva sobre este caso. Ou seja, rejeitar o que é falso; afastar o que não se pode provar, por insuficiente; dar como válido e adquirido aquilo de que se fez prova.
(…)
5. Há um cadáver não localizado, constatação validada pelos cães ingleses EVRD e CSI e corroborada pelos resultados laboratoriais preliminares
(...)
Para mim e para os investigadores que comigo trabalharam no caso até Outubro de 2007, os resultados a que chegámos foram os seguintes:
1. A menor Madeleine McCann morreu no apartamento 5A do Ocean Club, da Vila da Luz, na noite de 3 de Maio de 2007;
2. Ocorreu uma simulação de rapto;
3. Kate Healy e Gerald McCann são suspeitos de envolvimento na ocultação do cadáver da sua filha;
4. A morte poderá ter sobrevindo em resultado de um trágico acidente;

Iremos apresentar aprovas de que Madeleine não esteve no “high tea” ou “lanche ajantarado”, (4) (13) que esse mesmo “high tea” nunca teve lugar e que não há nenhum testemunho credível e independente que comprove que Madeleine tenha sido vista viva, depois da hora de almoço de domingo, dia 29 de Abril. (4) (13)
C. A duas descrições de um raptor, feitas por Jane Tanner e Nuno Lourenço
Iremos fazer também algumas observações acerca de outro aspecto, que é a descrição feita à PJ, sobre um raptor, por parte de um dos amigos dos McCann, Jane Tanner, na sexta-feira, dia 4 de Maio, e uma segunda descrição de um raptor de crianças, feita por Nuno Lourenço, no princípio do dia seguinte (sábado, dia 5 de Novembro).
Isto é o que Tavares de Almeida escreveu sobre as alegações de Jane Tanner (6):
CITAÇÃO
“Mais tarde,durante a manhã do dia 4 de Maio, o pai deu a mesma breve descrição [que Jane Tanner tinha dado] e remeteu o fornecimento de mais detalhes para Jane. Esta última [Jane Tanner] foi às instalações da Polícia Judiciária em Portimão às 11h30 da manhã. Desta vez, a sua descrição foi muito precisa:
O indivíduo, aparentando entre 35 e 40 anos, era magro e tinha cerca de 1,70 metros
Tinha o cabelo castanho escuro, caído sobre colarinho;
Usava umas calças beges ou cremes, provavelmente de linho;
Uma espécie de blusão – mas não muito grosso -
Sapatos pretos, de estilo clássico.
Caminhava apressadamente, com uma criança nos braços. Estava vestido com roupas quentes, razão porque pensou não se tratar de um turista. A criança parecia adormecida – ela apenas vislumbrou as pernas – tinha os pés descalços estava vestida com pijamas, que eram obviamente de algodão, com cores suaves, provavelmente branco ou rosa claro, com um padrão – flores, talvez, embora não esteja certa disso. Quanto ao homem, afirmou que o reconheceria pelas costas, devido à sua maneira peculiar de andar. A importância desta afirmação será entendida mais tarde.”

Abordemos agora a descrição de um indivíduo, feita por Nuno Lourenço à PJ, na manhã de dia 5 de Maio, sábado. (8) (9) (10) Nuno Lourenço firmou que esse homem tentou raptar a sua filha, junto a um café, na vila de Sagres, do dia 30 de Abril, domingo. Sabemos agora que, de acordo com a investigação da PJ, esse indivíduo foi identificado como Wojchiech Krokowski, (9) (10) (18) um cidadão polaco que estava de férias na Praia da Luz, na mesma semana em que os McCann lá estiveram. Gonçalo Amaral afirma o seguinte, no seu livro, sobre estas alegações de Nuno Lourenço (18):
CITAÇÃO:
“Da vila de Sagres, chega-nos a informação que, na Praia da Mareta, um turista tinha andado pela praia a tirar fotografias de forma dissimulada a várias crianças, entre elas uma menina de 4 anos de idade, com cabelo loiro e olhos azuis, muito parecida com a Madeleine (…) Uma equipa de investigação desloca-se ao local, conseguindo localizar o pai da menina em causa, pessoa na casa dos 40 anos de idade, com óculos graduados, vindo a saber que, para além das fotos tiradas no dia 29 de Abril, a meio da tarde, o suspeito de tal acto teria tentado agarrar a sua filha, na vila de Sagres, fugindo numa viatura de aluguer, onde se encontrava uma mulher no banco do pendura.”
“O «fotógrafo» não trajava como um turista, possuía o cabelo castanho-escuro a tapar o pescoço, usava calças de fazenda e um casaco, ambos de cor creme, os sapatos eram do tipo clássico de engraxar, parecia uma pessoa deslocada naquele meio de veraneio. Lembramo-nos das declarações da testemunha Jane Tanner quanto ao cabelo e à forma de vestir do possível raptor e, ainda, ao facto de o mesmo não parecer um turista.”
“Por sorte ou rapidez de raciocínio, o pai desta menina conseguiu tirar uma foto, com o seu telemóvel, do veículo conduzido pelo «fotógrafo». Esta foto não é muito nítida quanto à placa de matrícula, mesmo assim, vem a ser possível apurar a mesma. No rent-a-car onde aquela viatura foi alugada, identifica-se o seu condutor. Trata-se de um cidadão polaco que viaja na companhia da mulher, a sua idade ronda os 40 anos. Chegaram a Portugal no dia 28 de Abril, vindos de Berlim (Alemanha), num vôo da Air-Berlin. No Aeroporto de Faro, procederam ao aluguer da viatura, ficando alojados num apartamento em Budens, localidade sita perto da Praia da Luz. Precisamos de localizar este casal, onde estarão neste momento? Infelizmente, pelas 7 h deste dia 5 de Maio, já iniciaram a viagem de regresso a casa. Levam consigo a máquina fotográfica e as fotos efectuadas durante as férias. De imediato, via Interpol, pede-se a intervenção das autoridades policiais alemãs; para já, queremos que controlem o casal à chegada a Berlim. A polícia alemã faz um excelente trabalho, consegue falar com passageiros daquele voo, ninguém se recorda de uma menina com as características de Madeleine. Após a chegada a Berlim, o casal polaco tomou um comboio com destino à Polónia. E a pista polaca morreu. Queríamos muito saber quais eram as fotografias que este casal teria feito em Portugal.”

Tal como resulta claro, Gonçalo Amaral e a sua equipa de inspectores da PJ acreditaram que o homem visto por Nuno Lourenço em Sagres, no dia 30 de Abril, domingo, era o mesmo homem que Jane Tanner teria visto por volta das 9h15 da noite de dia 3 de Maio, (19) (20) quinta-feira, perto do apartamento dos McCann. As descrições são coincidentes:
a idade do indivíduo (35-40 ou 40)
cabelo castanho ou castanho escuro
cabelo 'até aos ombros' ou 'a cair sobre o colarinho'
calças cremes
'blusão' ou 'jaqueta'
sapatos de tipo clássico
'não parecia turista'(por usar 'roupas quentes')
Nesta carta, iremos provar que:
O depoimento de Nuno Lourenço foi uma completa fabricação;
O depoimento de Jane Tanner foi igualmente fabricado;
A similitude entre as duas descrições representa uma forte probabilidade de ambas terem sido planeadas muito antes de quinta-feira e
Houve conluio entre Jane Tanner, Nuno Lourenço e outros para criarem a falsa ideia da existência de um raptor (3) (9) (10).
D. PROVAS QUANTO À OCORRÊNCIA DA MORTE NO DOMINGO OU SEGUNDA-FEIRA - 1. Um grande número de depoimentos foi feito, logo ao princípio, contendo uma enorme quantidade de factos falsos. Estes factos falsos trouxeram credibilidade à alegação dos McCann segundo a qual Madeleine teria sido raptada no dia 3 de Maio, quinta-feira. Os mesmos factos desviaram a PJ da investigação, levando-a a acreditar que Madeleine estaria ainda viva naquele dia.
Tal como a PJ concluiu, concordamos que o falso rapto foi 'encenado'. E estamos também de acordo com o facto de a disposição da mobília do apartamento dos McCann ter sido alterada, no dia 3 de Maio, quinta-feira, para simular um cenário de rapto. Tudo isto tornaria necessária a cooperação dos McCann e dos seus 7 amigos.
Concordamos também totalmente com as provas apresentadas pela PJ (vide o relatório de Tavares de Almeida), segundo o qual:
a) houve múltiplas contradições nos depoimentos das testemunhas
b) houve múltiplas alterações nos depoimentos das principais testemunhas, e
c) os McCann foram adaptando a sua narrativa à medida que novos factos surgiam.
Com efeito, muito mais provas dessas contradições e alterações surgiram desde que Gonçalo Amaral foi afastado da investigação da PJ, no dia 2 de Outubro de 2007. Um exemplo, apenas, retirado do livro de Gonçalo Amaral: ele verificou correctamente que as descrições do Dr. David Payne sobre a sua visita a Kate McCann, no apartamento A5, eram contraditórias. Desde então, nós encontrámos pelo menos 20 contradições entre as suas duas versões acerca do que aconteceu. Consideramos que isto é mais do que suficiente para provar que a alegada 'visita' foi encenada. (21)
Três pessoas desempenharam um papel crucial para levar a investigação da PJ e Gonçalo Amaral a concluir que Madeleine teria morrido após as 5h30 da tarde de dia 3 de Maio, quinta-feira: Jane Tanner, Nuno Lourenço e Catriona Baker, a ama das crianças.
Abordamos a questão das declarações de Nuno Lourenço e Catriona Baker mais abaixo. Para já, resumimos as razões porque é que o depoimento de Jane Tanner deve ser considerado totalmente destituído de fiabilidade – tal como a equipa da PJ rapidamente concluiu:
1. Jane Tanner e o seu marido, Russel O'Brien, eram amigos íntimos dos McCann. Isso significa que ela nunca poderia ser uma testemunha independente.
2. No dia 13 de Maio, domingo, ela estava absolutamente certa de que o homem que ela alegava ter visto a transportar um embrulho ou uma criança, por volta das 9h15 da noite de dia 3 de Maio, quinta-feira, era Robert Murat. Esta identificação feita por Jane Tanner foi uma das principais razões para que Murat fosse chamado a depor dois dias depois (18).
3. Tornou-se claro, desde então, que horas antes de ela ser colocada numa carrinha, pela PJ, de forma a se poder verificar se ela conseguiria identificar o homem que alegava ter visto, ela foi contactada por um oficial superior da polícia de Leicestershire, o Superintendente-Chefe Bob Small e dois elementos de uma empresa de segurança financiada pelo governo britânico, a Control Risk Group (22). É razoável suspeitar que estas três pessoas tenham exercido influência sobre Jane Tanner, por forma a levá-la a fazer a falsa alegação de que teria 'reconhecido' Robert Murat.
4. Gonçalo Amaral, no seu livro, refere a súbita chegada a Portugal de um largo número de funcionários do governo britânico, da polícia e de pessoal ligado a serviços de segurança – diplomatas do ministério dos Negócios Estrangeiros, elementos da polícia de Leicestershire, da Scotland Yard, do MI5, do Special Branch, da National Police Improvement Agency, do CEOP e do Control Risk Group. Gonçalo Amaral refere concretamente o seguinte, no seu livro (18):
CITAÇÃO
“Os profilers ingleses são formais: há 90% de hipóteses de Murat ser o raptor de Madeleine”
“Os profilers ingleses, que assistiram ao primeiro interrogatório de Robert Murat, continuam a trabalhar, justamente, no seu perfil (…) os profilers acabam por definir o perfil de Robert Murat. Com uma forte probabilidade, de 90%, será ele o responsável pelo rapto de Madeleine.”
FIM DE CITAÇÃO
5. Tendo em conta o atrás exposto, consideramos haver provas claras de que existiu uma conspiração para acusar falsamente Robert Murat e persuadir a PJ a interrogá-lo e constituí-lo como suspeito formal, ou 'arguido'. E foi exactamente isto que aconteceu no dia 15 de Maio, terça-feira. (18)
6. Em Outubro de 2007, os assessores dos McCann divulgaram um esboço, feito por um artista, que corresponderia ao indivíduo visto por Jane Tanner. O esboço foi desenhado por um 'artista forense', Melissa Little. A artista tinha sido contratada por um homem de negócios de Cheshire, Brian Kennedy, que dirigiu a equipa de assessores dos McCann na sua extremamente polémica investigação privada. O esboço não apresentava semelhanças com Robert Murat.
7. Mais tarde, em Janeiro de 2008, uma notícia sobre um indivíduo com o cabelo espetado e bigode, considerado um novo 'principal suspeito' pela polícia de Leicestershire e pela equipa privada de assessores dos McCann, mereceu grande destaque em toda a Imprensa britânica. (20) (21) (22) (23) O responsável pelas relações públicas dos McCann, Clarence Mitchell (que, à data do seu desaparecimento era o chefe da Media Monitoring Unit do governo britânico) organizou uma conferência de Imprensa especial, ao estilo da polícia, para publicitar a existência deste novo suspeito. Melissa Little, mais uma vez, foi a autora do retrato-robô apresentado aos Media. Nalguns aspectos, o esboço apresentava semelhanças com o inicialmente feito, com base nas declarações de Jane Tanner. Jane Tanner também foi citada, na Imprensa britânica coo tendo afirmado que estaria '80% certa' de que o homem que teria visto no dia 3 de Maio era o mesmo homem, com o cabelo espetado e bigode. Isto, apesar de (a) ela admitir, com toda a franqueza, que não tinha chegado a ver a cara do homem no dia 3 de Maio e que (b) o homem com o cabelo espetado e bigode não apresentar qualquer semelhança com Robert Murat.
8. Também em Janeiro de 2008, Jane Tanner admitiu que 'já não estava certa' de que o homem que teria visto no dia 3 de Maio fosse Robert Murat (29) (30) (31)
9. Esta constatação era importante porque, nos dois dias seguintes àquele em que Robert Murat foi constituído arguido, três amigos dos McCann (Fiona Payne, Russel O'Brien e Rachel Oldfield) prestaram depoimentos à PJ, alegando terem visto Robert Murat perto do apartamento dos McCann na noite de 3 de Maio. No entanto, oito meses depois (Janeiro de 2008) todos admitiram que se 'poderiam ter enganado' (18).
10. Outra indicação de que o depoimento de Jane Tanner era falso surgiu durante uma conferência de Imprensa organizada pela equipa privada dos McCann, em Agosto de 2009 (29). Esta conferência de Imprensa foi organizada com o objectivo de promover a mais recente teoria dos McCann, segundo a qual Madeleine teria sido raptada por uma mulher, colocada num iate que viajou de Barcelona para a Austrália. De forma a publicitar esta teoria, o responsável pela equipa de investigadores privados dos McCann, o ex-Sargento-Detective Dave Edgar afirmou que Jane Tanner poderia ter-se enganado e ter visto uma mulher a transportar a criança, e não um homem.
11. Finalmente, é de acrescentar que, em 14 de Outubro de 2013, cerca de 7 milhões de pessoas em todo o Reino Unido viram um programa de televisão sobre o desaparecimento de Madeleine, elaborado conjuntamente pela BBC e pela Metropolitan Police (27), com um custo total de mais de 2 milhões de libras. No filme, o investigador principal da Metropolitan Police, Inspector-Chefe Detective Andy Redwood afirmou que o homem visto por Jane Tanner tinha 'contactado a polícia' e disse que a sua filha tinha estado na 'creche nocturna' e que ele a tinha levado, vestida apenas com pijama, para o local onde estava alojado naquela noite.
12. Há muitas razões para duvidar das alegações do Inspector-Chefe Detective Redwood (27). Por exemplo:
(a) porque razão é que aquele indivíduo esteve calado durante 6 anos?
(b) se o indivíduo passou perto do apartamento dos McCann, nessa noite, vindo da creche, o mapa do trajecto mostra que ele não escolheu o caminho mais directo, vindo da creche, mas deve ter dado uma volta muito maior.
(c) a identidade do indivíduo não foi revelada; apenas foi mostrada uma fotografia desfocada como sendo o tal indivíduo.
(d) foi dito que ele usava exactamente o mesmo tipo de roupas, em férias, como as descritas por Jane Tanner (ii) e a sua filha usava pijamas idênticos aos usados por Madeleine, durante aquelas férias e que (iii) ele, por razões que se desconhecem, guardou esses mesmos pijamas durante seis anos.
(e) não nenhuma explicação (i) quanto ao paradeiro da mãe dessa criança, enquanto o homem a levada, numa noite escura e fria (apenas 13 graus centígrados) (ii) e porque razão não utilizou um carrinho de bebé e (iii) porque razão a criança estava apenas de pijama, sem estar coberta por nada.
Em resumo, nenhum das dezenas de investigadores do caso, em Inglaterra, acredita que o DCI Redwood estava a dizer a verdade. Acreditamos que as suas afirmações foram mais uma mentira da polícia britânica, para continuar a afirmar que Madeleine teria sido raptada, o que não aconteceu.
E. PROVAS DA MORTE NO DOMINGO OU NA SEGUNDA-FEIRA – 2. A fotografia de Madeleine McCann, do Dr. Gerry McCann e de Amelie, tirada na piscina do Ocean Club
Uma das mais conhecidas fotografias de Madeleine é aquela em que ela está com a irmã Amelie e o pai, Dr. Gerry McCann, sentados junto à piscina do Ocean Club. Diz-se que esta fotografia foi tirada pela mãe, Dra. Kate McCann, no último dia das suas férias, quinta-feira, 3 de Maio, por volta das 2h29 da tarde.
Vamos apresentar um resumo das provas que sugerem que esta alegação é uma mentira deliberada dos McCann e daqueles que os apoiam (4) (32) (33) (34). Vamos demonstrar que esta fotografia foi tirada, quase de certeza, no domingo, dia 29 de Abril, à hora do almoço (4) (33). Vamos também demonstrar que esta foi a última foto que Madeleine tirou, com a possível excepção do "Foto com Maquilhagem" – abaixo reproduzida (14) (15). Para além disso, vamos mostrar que não nenhuma evidência credível e independente de que Madeleine estaria viva depois da tarde de domingo, dia 29 de Abril (13). Tendo em conta estas conclusões, também sugerimos que será improvável que a morte de Madeleine tenha sido 'acidental' (tal como sugerido no relatório da PJ) e também sugerimos que os pais de Madeleine tenham tido ajuda profissional, proveniente do mais alto nível do governo britânico, de forma a 'encenar' um rapto (conclusão da própria PJ) e para ajudar a manter o 'mito', durante mais de 10 anos, de que Madeleine teria sido raptada (2) (4) (5).
As provas relacionadas com a 'Última Foto' são as seguintes:
1. A fotografia terá sido tirada, segundo se diz, por Kate McCann. Dois reconhecidos especialistas em fotografia digital examinaram detalhadamente a foto e ambos, de forma independente, concordaram que era uma foto genuína sem sinais de ter sido alterada ou manipulada através de 'photoshop' (33).
2. Os especialistas também salientaram que, no entanto, seria relativamente simples alterar a data e a hora, para tentar provar que a foto teria sido tirada num momento diferente (33).
3. No dia 9 de Maio, o Dr. Gerry McCann e um familiar, Michael Wright, entregaram à PJ duas disquetes que, alegadamente, teriam todas as fotos de Madeleine, tiradas durante as férias, pelos McCann e seus amigos. Essas disquetes incluiriam três fotos de Madeleine, brincando alegremente no parque do Ocean Club, no primeiro dia de férias (sábado, dia 28 de Abril). Mas por razões que nunca foram explicadas pelos McCann, essas duas disquetes não incluíam a 'Última Foto'. (4)
4. Para além disso, resulta claro do processo da PJ que as fotos das duas disquetes foram compiladas com a ajuda de Alex Woolfall, o responsável pelo departamento de Riscos, que trabalhava para a importante empresa de relações públicas Bell Pottinger. Ele próprio admitiu isso. É estranho que o próprio responsável pelo departamento de Riscos de uma das maiores empresas de relações públicas do mundo tenha que, ele próprio, precisar de seleccionar as fotos das férias dos McCann (4) (33) (NOTA: Acrescentamos aqui a seguinte informação: 1. Sir Tim Bell, ex-presidente do Conselho de Administração da Bell Pottinger, admitiu que os McCann pagaram mais de 600 mil euros para 'manter o seu nome nas primeiras páginas dos jornais, durante um ano' e 2. Este ano, a Bell Pottinger entrou em colapso, e está agora sob administração judicial, depois de virem a público revelações acerca de uma campanha de mentiras, realizada na África do Sul, para apoiar o desacreditado presidente Jacob Zuma. A empresa e os seus responsáveis foram totalmente desacreditados. A Bell Pottinger também recebeu largas somas de dinheiro de diversos regimes corruptos e indivíduos que para eles trabalhavam, em diferentes zonas do globo).
5. O estado do tempo, quando a foto foi tirada Este é um ponto crucial, em matéria de provas, que a PJ não teve oportunidade para analisar. À hora do almoço de quinta-feira, dia 3 de Maio, o céu estava nublado e o tempo frio (17 graus ºC). Isto pode ser comprovado através de um conjunto alargado de dados meteorológicos e fotografias. Em contraste, o tempo no domingo, à hora do almoço (dia 29 de Abril) estava ensolarado e bastante quente (21 graus ºC). Na segunda-feira, uma frente fria trouxe tempo mais frio e nublado, com alguma chuva. Este estado do tempo manteve-se até sexta-feira (4) (33).
6. Olhando agora para os aspectos concretos da foto, observamos o seguinte:
(a) sol brilhante
(b) nenhum sinal de vento
(c) três pessoas sentadas na borda da piscina, mergulhando os pés na água
(d) o Dr. Gerry McCann vestindo uma camisola e calções curtos
(e) Madeleine e Amelie usando roupas leves
(f) o brilho de algumas gotas de suor na testa de Gerry McCann
(g) Gerry McCann usando óculos escuros (4) (33).
Nenhum destes pormenores está de acordo com a alegação de que a foto foi tirada na quinta-feira, dia 3 de Maio. Todos eles, no entanto, estão conformes à hipótese de a foto ter sido tirada no único dia de sol e calor daquelas férias: domingo, dia 29 de Abril.
7. A foto só foi entregue pelos McCann na quinta-feira, dia 24 de Maio. Porque razão é que, estando na máquina fotográfica dos McCann, não foi imediatamente fornecida, quando a polícia a a Comunicação Social pediram as fotos mais recentes de Madeleine?
F. PROVAS DA MORTE NO DOMINGO OU SEGUNDA-FEIRA – 3. A inexistência de fotos de Madeleine tiradas após domingo.
Alegadamente, apenas existirão cinco fotografias de Madeleine, tiradas durante aquelas férias.
Já aqui mencionámos quatro delas:
(a) Havia três fotos de Madeleine tiradas no sábado. O Dr. Gerry McCann entregou estas fotos à PJ no dia 9 de Maio de 2007
(b) Há a 'Última Foto', que os McCann afirmam ter sido tirada na quinta-feira, dia 3 de Maio. No entanto, já demonstrámos que teria que ter sido tirada no domingo, dia 29 de Abril.
Isso deixa apenas mais uma foto que os McCann alegam ter sido tirada durante aquelas férias: a foto referida como 'Foto das Bolas de Ténis', que mostra Madeleine a segurar algumas bolas de ténis.
Há numerosos problemas com esta foto (35) (36) (37). Os quatro principais são:
(1) Diz-se que duas pessoas diferentes teriam tirado esta foto (Kate McCann e Jane Tanner)
(2) Diz-se que terão sido tiradas em dias diferentes (terça-feira e quinta-feira) e
(3) As circunstâncias pouco prováveis em que, de acordo com o testemunho de Kate McCann (no seu livro publicado em 2011 'madeleine') a foto teria sido tirada )ela escreve que correu para o seu apartamento para ir buscar a máquina fotográfica, enquanto Madeleine, aparentemente, teria ficado ali, à espera que a fotografia fosse tirada.
(4) A fotografia parece ser inconsistente com aquilo que é dito por Kate McCann. Não é visível qualquer outra criança, na foto. Não há nenhuma ama das crianças ou treinadores de ténis na imagem, as bolas que a criança da foto segura são bolas de ténis para adultos, e não as bolas mais moles que as crianças usam, quando jogam 'mini-ténis'.
Para além disso, não nenhuma testemunha independente (tal como uma das amas da creche ou um treinador de ténis) que afirme que esta foto foi tirada onde e quando é suposto ter sido tirada.
A somar a isto, alguns analistas notaram que a cabeça da menina, na foto, é claramente a de Madeleine, mas o corpo parece ser diferente, em vários detalhes. Nomeadamente as pernas da menina, que parecem ser mais fortes, como se fossem de uma criança mais velha, enquanto os braços e pernas têm diversas manchas negras e arranhões, parecendo ainda vermelhas e queimadas do sol, quando comparadas com a pele branca de Madeleine, tal como se pode ver nas outras três fotos de Madeleine, tiradas no sábado, e na 'Última Foto' que nós temos a certeza terá sido tirada no domingo (4) (35) (36) (37).
Portanto, não temos qualquer prova da existência de qualquer fotografia de Madeleine tirada na segunda-feira, terça-feira, quarta-feira ou quinta-feira daquela semana. Isto é totalmente consistente com a nossa conclusão de Madeleine teria morrido no domingo.
É ainda de acrescentar que, de acordo com o senhor Philip Edmonds, director da empresa Stemcor, uma companhia siderúrgica internacional, que estava de férias, naquela semana, com os seus três filhos, no Ocean Club, este teria tirado uma foto aos seus três filhos, quando eles brincavam no parque infantil do Ocean Club, no sábado e que, nessa foto, se via Madeleine McCann em segundo plano. O senhor Philip afirmou publicamente ter entregue essa foto à PJ. No entanto, essa foto não aparece nos documentos do processo da PJ, nem foi nunca publicada em sítio algum. Há toda a razão para duvidar – mesmo que ele tivesse entregue a foto – de que isso provasse que Madeleine estaria viva naquele dia (38).
G. PROVAS DA MORTE NO DOMINGO OU SEGUNDA-FEIRA – 4. As falsas declarações de Nuno Lourenço, que tentou identificar Wojchiech Krokowsk como um potencial raptor de crianças que teria tentado raptar a sua filha, numa praia de Sagres.
Nuno Lourenço afirmou, alegadamente, que vivia na Alemanha e que foi a Sagres para umas curtas férias, a fim de visitar a sua mãe, que ainda vive naquela zona (8)
Ao princípio do dia 5 de Maio, sábado, ele contactou a PJ para informar que tinha visto um homem a fotografar crianças (incluindo a sua própria filha) na manhã de sábado, dia 29 de Abril (embora Gonçalo Amaral refira uma data diferente, no seu livro) (8) (18).
Nuno Lourenço forneceu uma foto, como prova das suas afirmações. Disse que tinha conseguido tirar uma foto do homem com o seu telemóvel, antes que ele abandonasse o local. Também forneceu à polícia os últimos quatro dígitos da matrícula do automóvel (8)
Na posse desta informação, a polícia portuguesa conseguiu descobrir que o carro era propriedade de uma agência de aluguer de automóveis situada em Burgau e que o carro tinha sido alugado, por uma semana, pelo senhor Wojchiech Krokowski. Krokowski e a esposa tinham estado a passar férias num apartamento do empreendimento "Sol e Mar", em Burgau. Mais tarde, a polícia recolheu mais informações sobre Krokowski e a sua esposa, através do dono ou do gerente do Burgau Beach Bar (que se julga ser o senhor Ralph Eveleigh ou o seu gerente), através uma câmara de vigilância de uma loja de Lisboa e da polícia polaca (8) (18).
Resulta claro, tendo em conta aquilo que referimos, na introdução deste carta, que Gonçalo Amaral e a sua equipa da PJ acreditaram que Nuno Lourenço teria identificado o mesmo homem visto por Jane Tanner (8).
Se compararmos agora as descrições de Jane Tanner (acerca do homem que ela teria visto) e de Nuno Lourenço (sobre o homem que agora sabemos ser Wojchiech Krokowski), as semelhanças são espantosas, a avaliar pelo seguinte quadro de referências:

Em relação ao depoimento de Nuno Lourenço, temos a assinalar o seguinte (3):
1. A descrição que ele faz do que teria sido uma tentativa de rapto não é credível, sob vários pontos de vista:
(a) porque é que um turista, com o carro aparentemente estacionado a alguma distância, fora da localidade, tentaria (em plena luz do dia) raptar uma criança?
(b) porque é que não mais nenhuma testemunha desta ocorrência?
(c) o seu relato de que tentou tirar uma foto de Krokowski mas não conseguiu porque tinha um dedo sobre o visor, também não é credível
(d) a sua descrição sobre o que aconteceu dentro e fora do café também não tem um 'selo de credibilidade'
(e) só comunicou à polícia o que teria sido (caso fosse verdade) um episódio assustador seis dias depois
(f) colocou muita ênfase no facto de o registo da data e hora do seu telefone móvel 'provar' que a foto do carro de Krokowski tinha sido tirada por vota das 6 horas da tarde de domingo, dia 29 de Abril. Isto traz-nos à memória o facto de se ter dito que outra foto, a 'Última Foto', teria sido tirada na quinta-feira, dia 3 de Maio, quando tudo indica que teria sido tirada quatro dias antes. Achamos que o mais provável, em qualquer circunstância, é que Nuno Lourenço teria tirado a foto mais tarde, naquela semana, mas teria modificado o registo por forma a enganar a equipa de investigação da PJ, levando-os a acreditar que a foto teria sido tirada no domingo.
(g) ele só telefonou à polícia seis dias depois e esperou até que Jane Tanner prestasse o seu depoimento à polícia
(h) para além disso, esperou até que o avião que levava Krokowski e a esposa de regresso à Polónia levantasse vôo do aeroporto de Faro. Isto parece-nos ser mais do que uma simples coincidência (9) (10)
Tendo todos estes aspectos em consideração e tendo ainda em conta as espantosas coincidências entre as descrições feitas por Jane Tanner (acerca do homem) e de Nuno Lourenço (acerca de Wojchiech Krokowski), chegámos às seguintes – e perturbadoras – conclusões:
1) Jane Tanner e Nuno Lourenço descreveram o mesmo homem - Wojchiech Krokowski
2) A descrição teria que ser fundamentada em Wojchiech Krokowski e nas roupas que estaria a usar, naquela semana
3) Ou Jane Tanner e Nuno Lourenço estariam conluiados, de forma a fornecer à polícia uma descrição idêntica OU, no mínimo, uma terceira parte teria planeado este conluio e ter-lhes-ia dado instruções sobre o que dizer à polícia (3).
Isto significa que Jane Tanner, Nuno Lourenço e todo e qualquer outro indivíduo que estivesse em conluio com o objectivo de enganar a polícia, desta forma, teria cometido o crime (segundo a lei inglesa) de perverter o curso da Justiça. De acordo com as leis inglesas, este crime traria uma condenação de até um máximo de 14 anos de prisão.
[ NOTA: Acrescentamos aqui o estranho caso do testemunho de três membros da família Smith, que afirmaram ter visto um homem a transportar uma criança vestida apenas com pijama, por volta das 10 horas da noite de quinta-feira, dia 3 de Maio. O que é espantoso é que, quando viajaram para Portugal, para prestar os seus depoimentos, no dia 26 de Maio, tenham feito uma descrição praticamente idêntica à de Jane Tanner e Nuno Lourenço, acerca do homem que viram.
A família Smith também descreveu um homem com 'cerca de 35-40 anos', 'usando roupa grossa', 'sapatos de estilo clássico' e que 'não parecia ser turista'. A menina que transportava também usava apenas um pijama em tons de branco/rosa.
Se nós estivermos correctos na nossa sserção de que Madeleine estaria provavelmente morta no domingo, então qual seria a explicação possível para o facto de ele afirmar ter visto alguém, por volta das 10 horas da noite de quinta-feira, dia 3 de Maio, cuja descrição é idêntica àquela feita por Jane Tanner e Nuno Lourenço?
Isto levanta a hipótese concreta de se estar também perante uma fabricação e que Martim Smith e a sua família estariam também a usar a mesma descrição de Wojchiech Krokowski.
Podemos acrescentar que, no dia 20 de Setembro de 2007, nove dias depois de ter visto imagens na TV de Gerry McCann a transportar o seu filho Sean, descendo as escadas à saída do avião, Martim Smith afirmou (com uma certeza entre 60 a 80 %) que o homem que viu no dia 3 de Maio seria Gerry McCann. No entanto, apesar disso, ele admitiu ter sido contactado pelo senhor Brian Kennedy, responsável pela direcção da investigação privada dos McCann, em Dezembro de 2007 e que, desde essa altura, tem estado a colaborar com os McCann, fazendo declarações públicas que mostram simpatia para com os McCann e apelando às pessoas para que 'procurem o raptor' ] (3).
H. PROVAS DA MORTE NO DOMINGO OU NA SEGUNDA-FEIRA – 5. Testemunho pouco fiável da ama das crianças, Catriona Baker, do Dr. Gerry McCann e da Dra. Kate McCann sobre um alegado 'high tea' ou 'lanche ajantarado' no restaurante Tapas do Ocean Club, entre as 5 ou 6 horas da tarde de quinta-feira, dia 3 de Maio.
As provas cruciais de que Madeleine estaria viva por volta das 5h30 da tarde de quinta-feira, dia 3 de Maio, vieram de uma das amas da creche, Catriona Baker (39) (40) (41). Ela era também a ama encarregue do grupo de dia de Madeleine, as 'Lagostas'. Tanto Tavares de Almeida como Gonçalo Amaral, no seu livro, estavam convencidos de que ela dizia a verdade e que, por ser considerada uma testemunha 'independente', podiam confiar na sua palavra (18)
No entanto, investigações mais detalhadas descobriram uma série de contradições entre as quatro principais testemunhas que prestaram depoimentos sobre aquele alegado 'high tea' ou 'lanche ajantarado' na tarde de quinta-feira: o Dr. Gerry McCann, Kate McCann as amas da creche Catriona Baker e Charlotte Pennington (12). Essas contradições foram analisadas por muitos dos investigadores do caso Madeleine. Todos eles chegaram à conclusão de que as contradições são tantas e tão graves que é de duvidar seriamente que esse 'high tea' ou 'lanche ajantarado' alguma vez tenha ocorrido, pura e simplesmente. É completamente impossível aceitar Catriona Baker como uma testemunha da verdade.
Para além disso, as investigações levaram-nos a concluir que Catriona Baker provavelmente conheceu os McCann antes daquelas férias (4).
Os registos da rede social Facebook mostram que Catriona Baker era, em 2006 e talvez antes disso, amiga de Chloe Corner no Facebook. Chloe Corner é a filha do padrinho de Amelie, Jon Corner. Jon Corner esteve profundamente envolvido nos acontecimentos posteriores ao desaparecimento de Madeleine. Poucas horas depois, ele foi capaz de, aparentemente, enviar um número ilimitado de fotos de Madeleine aos órgãos de Comunicação Social, a partir da sua casa em Liverpool. Para além disso, Jon Corner disse que tinha estado, anteriormente e por várias vezes, na Praia da Luz, dando a entender ter alguma ligação com aquela localidade. Jon Corner também esteve a viver na mesma residência que os McCann, em Agosto de 2007, durante cerca de uma semana, quando levou o casal a Huelva, para distribuírem panfletos sobre o desaparecimento de Madeleine. Ele fez ainda um documentário sobre Madeleine que foi transmitido, mais tarde, pelo programa "Panorama", na sua emissão sobre Madeleine, transmitida a 19 de Novembro de 2017 (4).
Em Novembro de 2007, seis meses depois do desaparecimento de Madeleine, Catriona Baker visitou os McCann em Rothley, ficando em sua casa durante alguns dias. Há também elementos que constam do livro de Kate McCann, 'madeleine', que indicam que ela a poderia ter conhecido antes, embora não admita isso (4).
Estas ligações de Catriona Baker a Jon Corner e aos McCann não eram conhecidas da equipa de investigação da PJ nem de Gonçalo Amaral, na altura. Se fossem conhecidas, não a teriam considerado tão rapidamente como uma testemunha 'independente'.
I. PROVAS DA MORTE NO DOMINGO OU SEGUNDA-FEIRA – 6. A inexistência de qualquer testemunho credível, independente, por parte seja de quem for, de que Madeleine tivesse sido vista viva depois de domingo, dia 29 de Abril.
Já dissemos que Madeleine foi vista viva no domingo, dia 29 de Abril, à hora do almoço. Apresentámos provas de que não podemos ter em conta os testemunhos de Catriona Baker e dos McCann, segundo os quais Madeleine estaria viva e teria participado de uma alegado 'high tea' ou 'lanche ajantarado', na tarde de quinta-feira. (Charlotte Pennington, mais tarde, fez um depoimento sobre este alegado 'high tea' ou 'lanche ajantarado', mas esse depoimento também foi contraditório em relação a outros três depoimentos).
Todas as restantes alegações de testemunhas que dizem ter visto Madeleine depois de domingo foram examinadas em detalhe por uma britânica que agora vive no Canadá, Lizzy Taylor (13). Ela concluiu que, para além dos depoimentos dos McCann e dos seus 7 amigos – que, obviamente, não são testemunhas independentes – todos os outros testemunhos que alegam tê-la visto são muito duvidosos. Alguns são extremamente vagos, sem pormenores que permitam a sua confirmação. Outros são totalmente incorrectos – por exemplo, testemunhas que alegam ter visto Madeleine a tomar o pequeno-almoço com os McCann no restaurante Millennium quando os McCann, nos seus depoimentos, afirmaram repetidamente que tomaram o pequeno-almoço no apartamento, todos os dias, de segunda-feira em diante.
A inexistência de outras testemunhas fiáveis que afirmem ter visto Madeleine depois de segunda-feira é algo preocupante e é um forte indício que confirma que Madeleine não estava viva, depois de domingo.
J. PROVAS DA MORTE NO DOMINGO OU SEGUNDA-FEIRA - 7. O mistério da estranha 'Foto com Maquilhagem', que parece ter sido tirada no domingo, dia 29 de Abril
A 'Foto com Maquilhagem' foi inicialmente divulgada num curto vídeo de 2 minutos, feito pelo padrinho de Amelie, Jon Corner. A foto mostra Madeleine com uma maquilhagem bastante carregada, nomeadamente:
um colar
um travessão no cabelo
batom
sombra nos olhos
lápis para os olhos
É também de referir que, nessa foto, Madeleine tem as pupilas dilatadas e não há, na sua expressão, qualquer sinal de alegria ou felicidade. Pelo contrário, parece profundamente infeliz. Muitos observadores têm, compreensivelmente, chamado a esta foto a foto da 'Lolita' (42).
Quando esta foto foi divulgada, atraiu muitos comentários negativos, incluindo os de um jornal de referência, o "Independent". Um conhecido criminólogo, Mark Williams-Thomas, também criticou os McCann por terem divulgado esta foto (embora não seja claro se os McCann terão dado ou não permissão para que a foto fosse divulgada) (42).
Os McCann afirmaram que a 'Foto com Maquilhagem' mostrava Madeleine 'a brincar com a caixa de maquilhagem da mamã' e disseram à Comunicação Social que a fotografia tinha sido tirada 'algumas semanas antes' das suas férias na Praia da Luz (42).
Muitos dos investigadores do caso Madeleine que estudaram a foto cuidadosamente fizeram este conjunto de observações (14) (15):
1) Madeleine não poderia ter aplicado o lápis para os olhos sozinha. Não poderia também ter aplicado o batom e a sombra azul nos olhos tão cuidadosamente. Certamente que ela não teria conseguido, sozinha, colocar o colar nem o travessão no cabelo. Um adulto poderia ter feito tudo isso, mas não foi revelado quem o fez. Por isso, os McCann não disseram a verdade quanto às circunstâncias em que esta foto foi tirada. Isto significa que nos é permitido colocar questões muito sérias sobre quem, onde e porque razão foi esta foto tirada.
2) Na foto, vemos que Madeleine tem as pupilas dilatadas.
3) Madeleine não mostra nenhum sinal de alegria ou felicidade nesta foto, como seria de esperar se estivesse a brincar com a caixa de maquilhagem da mãe. Pelo contrário, parece haver tristeza ou até receio, ou medo, no seu olhar.
4) A foto é tirada com uma parede de estuque como fundo, de cor creme, amarela ou ocre. Este tipo de revestimento é pouco usado nas habitações inglesas. No entanto, é muito semelhante ao tipo de revestimento usado em muitas habitações na zona costeira algarvia, em Portugal.
5) O aspecto de Madeleine, na 'Foto com Maquilhagem' é muito parecido ao da ´Última Foto', que nós já concluímos ter sido tirada no domingo. Em ambas as fotos:
(a) o comprimento dos cabelos, o estilo e a cor são idênticos
(b) em ambas, Madeleine usa um travessão no cabelo (embora em posições diferentes) e
(c) em ambas, ela usa uma bata, um top ou vestido em tons de rosa
Tenso em conta especialmente o que foi referido acima no ponto 5, temos o direito de questionar se esta foto poderia ter sido tirada durante as férias dos McCann na Praia da Luz, possivelmente no mesmo dia em que foi tirada a 'Última Foto' – domingo, dia 29 de Abril.
K. Provas fotográficas irrefutáveis de que o mesmo pijama que Madeleine tinha vestido nas férias na Praia da Luz foi, mais tarde, mostrado pelos McCann durante duas conferências de Imprensa, uma em Londres, a 5 de Junho de 2007, a outra em Amsterdão, na Holanda, a 7 de Junho de 2007.
Aqui baseámo-nos, primeiro, em factos que podem ser vistos no filme 'Madeleine: Porquê o Encobrimento?', de Richard D. Hall, cujo link é este:

Em síntese, o filme de Richard D. Hall e o texto do DR. Roberts revelam o seguinte:
1. O pijama de Madeleine foi fotografado pelos McCann antes de estes darem o alarme sobre o desaparecimento de Madeleine, por volta das 10 horas da noite de 3 de Maio.
2. Provas fotográficas muito claras (e outro tipo de provas) mostram que um par igual de pijamas foi mostrado, pessoalmente, pelos McCann, em duas conferências de Imprensa, uma em Londres, a 5 de Junho de 2007, a outra em Amsterdão, na Holanda, a 7 de Junho de 2007.
Destes dois factos resulta que a alegação dos McCann, segundo a qual Madeleine teria sido raptada, vestida com o seu pijama, entre as 9h15 e as 10h00 da noite, é falsa. Madeleine deverá então ter desaparecido em circunstâncias completamente diferentes. Tal como o Dr. Roberts salienta, no seu texto: "Se o pijama de Madeleine não foi raptado, então ela também não foi raptada".
OBJECÇÕES QUANTO À NOSSA TEORIA
Um certo número de objecções têm sido levantadas, sobre esta nossa teoria. Aqui fazemos uma lista dessas objecções e respondemos a elas, de forma breve:
1 'Teria sido impossível haver tanta gente a mentir sobre a morte de uma criança e a participar no seu encobrimento'
2 'Ninguém teria coragem para encenar um falso desaparecimento, 3-4 dias depois de a sua filha estar morta'
3 'Os McCann e os seus amigos não poderiam ter todos concordado em participar no encobrimento da morte de uma criança'
4 'É impossível que Catriona Baker, a ama da creche de Madeleine, pudesse ter ajudado a falsificar os registos da creche e mentisse sobre o facto de Madeleine não ter estado na creche de domingo em diante'
5 'A senhora Fenn ouviu Madeleine a chorar e a chamar pelo pai, entre as 10h30 e as 11h45 da noite de 1 de Maio'
Como resposta, destacamos os seguintes pontos.
Em relação ao testemunho da senhora Fenn, há vários problemas:
(a) ela não prestou nenhum testemunho sobre o facto de ter ouvido Madeleine chorar até ao dia 20 de Agosto, cerca de 3 meses e meio depois do dia 1 de Maio, terça-feira (43)
(b) também não prestou nenhum testemunho sobre o facto de ter ocorrido um alegado arrombamento no seu apartamento até ao dia 20 de Agosto (44)
(c) uma análise de todas as declarações que fez sobre o alegado arrombamento mostra grandes contradições, nomeadamente sobre quando é que o suposto assalto teria ocorrido, o que teria acontecido dentro do apartamento, como é que o intruso teria escapado e quem mais é que estaria lá, na mesma altura (44)
(d) o seu testemunho foi revelado antecipadamente e publicado na Imprensa britânica nos dias 18 e 19 de Agosto – isto é, antes de ela ter prestado o seu depoimento, o que sugere que o fez em conluio com outros (4) (43) (44)
(e) ela afirma ter ouvido Madeleine chorar durante mais de 75 minutos – no entanto, mais ninguém naquele bloco de apartamentos ouviu o choro
(f) ela exagerou no seu depoimento, ao afirmar que o choro era de uma criança 'com mais de dois anos de idade' – quando não é possível fazer um tipo de distinção deste género, entre o choro de uma criança de três anos e de uma criança de dois anos
(g) ela não procurou ajuda, alertando alguém para o choro que ouviu, excepto num alegado telefonema para uma tal senhora Edna Glyn que, tanto quanto nos é dado saber, através do processo de investigação da PJ, a polícia portuguesa não conseguiu confirmar
(h) ela própria disse aos jornalistas para ignorarem tudo o que os jornais tinham publicado sobre o seu depoimento
Há mais detalhes sobre os múltiplos problemas relacionados com o seu depoimento nestes links (43) (44):
Em relação aos outros pontos acima referidos, nós pura e simplesmente não sabemos como é que Madeleine morreu, sobretudo agora que parece certo que ela morreu no domingo ou, provavelmente, na segunda-feira. É possível e, de facto, até consideramos isso provável, que ela tenha morrido em circunstâncias em que os McCann e os seus amigos julgassem poder haver sérias consequências, para todos eles, caso o corpo de Madeleine fosse autopsiado. Quanto a este aspecto, mencionamos as observações sexualmente sugestivas que o Dr. David Payne fez acerca de Madeleine, tal como foram referidas a 19 de Maio de 2007 pelo Dr. Arul e Dra Katarina Gaspar. Também achamos importante referir que os dois depoimentos da família Gaspar só foram enviados à PJ cerca de três semanas depois de Gonçalo Amaral ter sido afastado do caso.
Tem sido sugerido que a morte de Madeleine não poderia ter sido encoberta devido ao grande número de pessoas envolvidas. Em resposta a isso, salientamos que apenas um número reduzido de pessoas teria que estar envolvido para manter a sua morte em segredo. No domingo à noite, pouca gente conheceria Madeleine, para além dos '7 amigos do restaurante Tapas' e de Catriona Baker, a ama da creche (que, tal como referimos, já seria amiga dos McCann). Provavelmente, o gerente do Ocean Club e alguém responsável da empresa Mark Warner poderiam ter sido informados e poderia ter sido tomada uma decisão colectiva de manter a morte de Madeleine em segredo e planear um falso rapto (45) (46) (47).
Se a morte de Madeleine foi em resultado de qualquer acto criminoso, isso seria uma razão fortíssima para todos os envolvidos encobrirem o sucedido. O encobrimento e o falso rapto poderiam então ter sido levados a cabo em total segredo.
Os factos apontam para a morte no domingo ou, o mais tardar, na segunda-feira.
Este, sugerimos nós, deverá ser um ponto importante, a ter em conta, na nova investigação que as autoridades portuguesas estão a levar a cabo, desde 2013.
Concluímos sugerindo aquilo que nos parece ser, agora, óbvio para as autoridades portuguesas: que a Operação Grange, a investigação da Metropolitan Police sobre a morte de Madeleine, nunca foi uma tentativa genuína, por parte da polícia britânica para descobrir a verdade sobre o que realmente aconteceu a Madeleine

Affairs was in charge of translating to Portuguese and Chinese all legal
