English to Spanish Law/Patents Law: Contract(s) Memorando de acuerdo
El término aparece en la cláusula de confidencialidad de un memorando de acuerdo. Sé que es una construcción habitual en este tipo de cláusulas, pero no consigo entender la estructura y encontrar una equivalencia.
Contexto:
The restrictions and prohibitions set out shall not apply to any Confidential Information that the receiving Party can show by documentary evidence:
- was known to it prior to disclosure by the disclosing Party;
- was disclosed to the receiving Party by a third party having no obligations of confidentiality towards the Parties;

Según el DRAE documental y documentario/a es lo mismo (documentario se usa más en América)

I have searched for the terms prueba and evidencia in all of the national criminal procedure codes of the 20 Spanish-speaking countries and here are the approximate number of times that the words appeared:

prueba: 2,439
evidencia: 167

Zooming in on the term evidencia, we can see that the main users are Colombia and Puerto Rico:

Colombia: 87
Puerto Rico: 46

Interestingly, the two countries that use the term evidencia the most, are the only ones that have adopted the American procedure of discovery and call it descubrimiento. The rest of the 18 Spanish-speaking countries use the term evidencia in their codes a total of 33 times.

In my opinion, we cannot rule out the evidence>evidencia translation, but we ought to use the evidence>prueba translation instead because the TL term is by far, very far, the more popular term and that it is universally understood in every Spanish-Speaking country.

agree jacana54 (X) : El DRAE define "evidencia: certeza clara y manifiesta de la que no se puede dudar/prueba determinante". Por eso evidence y evidencia son falsos amigos y conviene usar "prueba".
