The commitments set forth in this Section shall not extend to any portion of CONFIDENTIAL INFORMATION which, as established by relevant documentary evidence satisfactory to BUYER, (a) is already in SELLER’s lawful possession at the time of disclosure by the BUYER; (b) is through no act on the part of the SELLER, generally available to the public;
