محكمة التمييز الاتحادية
هي الهيئة القضائية العليا التي تدقق القرارات الصادرة من المحاكم المدنية ومحاكم الاحوال الشخصية ( العائلة ) والمحاكم الجنائية بالنسبة للجرائم التي تزيد عقوبتها على (5) سنوات ومحكمة التمييز واحدة في العراق مقرها العاصمة بغداد وتتكون من عدة هيئات :-



الهيئة العامة :
وتضم كافة اعضاء المحكمة ( عدد الاعضاء حاليا 27 مع الرئيس ونائبه ) وتنعقد مرة واحدة في نهاية الشهر برئاسة رئيس المحكمة او نائبه لتدقيق القضايا المهمة التي يقرر الرئيس تدقيقها من الهيئة العامة .

الهيئة الموسعة الجزائية :
وتضم القسم الاكبر من اعضاء المحكمة بشرط ان لا يقل عن (15) عضو وتنعقد برئاسة رئيس المحكمة او نائبه وتختص بتدقيق القضايا الصادرة فيها عقوبة الاعدام او القضايا الجنائية التي يقرر الرئيس تدقيقها من هذه الهيئة .

الهيئة الموسعة المدنية :
وتضم عدد من اعضاء المحكمة بشرط لا يقل عددهم عن (7) وتختص بتدقيق القضايا المدنية المهمة او التي يقرر الرئيس تدقيقها من هذه الهيئة .

The Courts of Supreme Judicial Council

First :- Court of Cassation:

It is the supreme judicial commission that scrutiny the decisions issued by the civil courts , personal status courts (family courts) and criminal courts regarding the crimes with sentence of more than (5) years. The Court of Cassation is only one in Iraq , its headquarter is in Baghdad and consists of many commissions:-

The General authority:
It consists of all members of the court (currently , they are 27 including the Chief and Vice-Chief). It is held once at the end of the month and chaired by the chief or the vice-chief in order to scrutiny penalty the important cases that the chief decides to be examined by the general panel.



Criminal Expanded Commission:
It consists of the largest part of the members of the court provided that they are not less than (15) members. It is held and chaired by the chief or the vice-chief of the court and it is competent in scrutiny the death sentences cases or the criminal cases that the chief decides to be scrutinzed by this commission.



Civil Expanded Commission:
It consists of a number of members of the court provided that they are not less than (7) and it is competent in examining the important civil cases or the cases that the chief decides to be examined by this commission.
