El presente documento subraya la importancia de descolonizar la justicia estatal en un escenario de justicia transicional. De esta manera se puede desarrollar y materializar el pluralismo jurídico, con miras a generar procesos restaurativos que dignifiquen los derechos de los pueblos indígenas, rrom, negros, afrocolombianos, raizales y palenqueros, afectados de manera grave, diferenciada pero siempre desproporcionada, en el marco del conflicto armado. La idea central de este documento es: el derecho ordinario representa un proyecto hegemónico monocultural, que se disfraza, se cambia de nombre, se apropia de luchas y se adapta, para silenciar sujetos considerados como “otros” en sus múltiples y variados procesos y contextos culturales. La opresión y exclusión, si bien no nacen en el derecho, son muchas veces legitimadas y profundizadas por el derecho. Las normas jurídicas sirven como meros enunciados de formas ideales de conductas o derechos, que en la práctica no se materializan sobre todo con relación a las poblaciones o los pueblos que más se podrían beneficiar con la aplicación efectiva de las normas.

Justice for its own sake


Explanation:
While it is true that custom has served as a subsidiary source of law at least in the common law system (see James' Introduction to English Law), I don't think it is what is meant in the present context. It seems to meet that the author of the text wants to differentiate between statutory justice and what he/she considers to be real or actual justice.
