Source text - Dutch 10. VERHAAL
De huurder zal tegen de verhuurder enkel verhaal mogen uitoefenen indien het is bewezen dat deze laatste, na erover te zijn ingelicht, niet onmiddellijk alle maatregelen heeft getroffen om eraan te verhelpen. Hetzelfde geldt voor de verantwoordelijkheid voortvloeiend uit artikelen 1386 en 1721 van het B.W.
De huurder zal de verhuurder onmiddellijk op de hoogte brengen van de schade ontstaan aan het dak en van alle andere, door de wet of de huurovereenkomst aan de verhuurder opgelegde herstellingen. Hij zal deze herstellingen moeten dulden, zelfs indien zij meer dan 40 dagen in beslag nemen en verklaart te verzaken aan eender welke vergoeding voor genotsderving.
In geen geval zal de huurder op eigen initiatief werken of herstellingen mogen (laten) uitvoeren die aan de verhuurder zijn opgelegd en die niet van absoluut dringende aard zijn.
11. VERANDERINGEN AAN HET GEHUURDE GOED
Alle werken, verfraaiingen, verbeteringen of veranderingen aan het gehuurde goed zullen enkel mogen uitgevoerd worden met het schriftelijk akkoord van de verhuurder.
Behoudens andersluidende overeenkomst, opgenomen in een schriftelijke en voorafgaande toelating, zullen de werken, zonder vergoeding, ten bate van de verhuurder verworven blijven: deze behoudt zich evenwel het recht voor te eisen dat de plaatsen in hun oorspronkelijke staat hersteld worden.
De huurder mag geen buiten – antenne plaatsen zonder het schriftelijk akkoord van de verhuurder.
Translation - Slovak 10. NÁHRADA ŠKODY
Nájomca si bude môcť voči prenajímateľovi uplatniť náhradu škody, ak sa dokáže, že posledný menovaný neuskutočnil ihneď po obdržaní oznámenia všetky možné opatrenia, vedúce k odstráneniu škody. To isté platí aj pre zodpovednosť, vyplývajúcu z článkov 1386 a 1721 Občianskeho zákonníka.
Nájomca prenajímateľovi bezprostredne oznámi škodu vzniknutú na streche a všetky ostatné opravy, uložené prenajímateľovi zákonom alebo nájomnou zmluvou. Tieto opravy bude musieť znášať dokonca aj vtedy, ak potrvajú dlhšie ako 40 dní a vyhlasuje, že sa zrieka akejkoľvek náhrady škody za obmedzenie užívania.
Nájomca nesmie v žiadnom prípade z vlastnej iniciatívy (dať) vykonať práce alebo opravy, ktoré boli uložené prenajímateľovi a ktoré nie sú absolútne naliehavé.
11. ZMENY NA PRENAJATEJ NEHNUTEĽNOSTI
Akékoľvek práce, skrášlenia, zlepšenia alebo zmeny na prenajatej nehnuteľnosti bude možné vykonávať len s písomným súhlasom prenajímateľa.
Ak nebolo dohodnuté inak, v rámci predchádzajúceho písomného súhlasu, ostávajú výsledky prác, bez náhrady nákladov, v prospech prenajímateľa: ten si taktiež vyhradzuje právo požadovať, aby boli miesta uvedené do pôvodného stavu.
Nájomca nesmie bez písomného súhlasu prenajímateľa nainštalovať na nehnuteľnosť vonkajšiu anténu.

Source text - German Der Zweite Senat des BVerfG hat mit Urteil vom 18. 7. 2005 das Europäische Haftbefehlsgesetz für nichtig erklärt. Das Gesetz greife unverhältnismäßig in die Auslieferungsfreiheit (Art. 16 II GG) ein, da der Gesetzgeber die ihm durch den Rahmenbeschluss zum Europäischen Haftbefehl eröffneten Spielräume nicht für eine möglichst grundrechtsschonende Umsetzung des Rahmenbeschlusses in nationales Recht ausgeschöpft habe. Zudem verstoße das Europäische Haftbefehlsgesetz auf Grund der fehlenden Anfechtbarkeit der (Auslieferungs-)Bewilligungsentscheidung gegen die Rechtsweggarantie (Art. 19 IV GG). Solange der Gesetzgeber kein neues Ausführungsgesetz zu Art. 16 II 2 GG erlässt, ist die Auslieferung eines deutschen Staatsangehörigen daher nicht möglich. Damit war die Verfassungsbeschwerde des Beschwerdeführers, der auf Grund eines Europäischen Haftbefehls zur Strafverfolgung an Spanien ausgeliefert werden soll, erfolgreich. Der Beschluss des OLG und die Bewilligungsentscheidung der Justizbehörde wurden aufgehoben. Der Richter Broß, der die Entscheidung im Ergebnis mitträgt, der Richter Gerhardt und die Richterin Lübbe-Wolff haben der Entscheidung jeweils eine abweichende Meinung angefügt.
Translation - Slovak Druhý senát Spolkového ústavného súdu (Bundesverfassungsgericht, ďalej len „BVerfG“) vo svojom rozhodnutí z 18. 7. 2005 vyhlásil zákon o európskom zatýkacom rozkaze za neplatný. Zákon podľa neho neprimerane zasahuje do práva nebyť vydaný (čl. 16 II Ústavy, ďalej len „GG“), keďže zákonodarca naplno nevyužil možnosti, ktoré mu poskytlo rámcové rozhodnutie k európskemu zatýkaciemu rozkazu na implementáciu rámcového rozhodnutia do vnútroštátneho práva v podobe, ktorá by čo najväčšmi chránila základné práva. Zákon o európskom zatýkacom rozkaze navyše pre chýbajúcu možnosť napadnúť rozhodnutie o povolení (vydania) porušuje právo na prístup k súdu (čl. 19 IV GG). Kým zákonodarca nevydá nový vykonávací zákon k čl. 16 II 2 GG, nebude preto vydanie nemeckého štátneho príslušníka možné. Ústavná sťažnosť sťažovateľa, ktorý mal byť na základe európskeho zatýkacieho rozkazu vydaný na trestné stíhanie do Španielska, tak bola úspešná. Rozhodnutie Vrchného krajinského súdu (Oberlandesgericht, ďalej len „OLG“) a rozhodnutie o povolení justičného úradu boli zrušené. Sudca Broß, ktorý podporil výsledné rozhodnutie, sudca Gerhardt a sudkyňa Lübbe-Wolff k rozhodnutiu pripojili každý odlišné stanovisko.

Source text - Dutch Vanwege de verkeersveiligheid mogen voertuigen pas op de Europese markt worden gebracht wanneer zij aan bepaalde toelatingseisen voldoen. Deze eisen worden voor het grootste gedeelte bepaald door internationale wetgeving. Een certificeringsinstantïe zorgt voor de goedkeuring, "homologatie" genaamd, door middel van het afgeven van diverse" certificaten voor het desbetreffende voertuig. Een deel van de vereiste certificaten van het onderhavige voertuig werd verzorgd door de leverancier van het onderstel.
Translation - Slovak Na zaistenie bezpečnosti cestnej premávky sa smú vozidlá uvádzať na európsky trh až po splnení určitých požiadaviek na typové schválenie. Väčšina týchto požiadaviek je stanovená medzinárodnou legislatívou. Certifikačný orgán zabezpečí schválenie, tzv. „homologizáciu“, vydaním rôznych osvedčení pre dané vozidlo. Časť požadovaných osvedčení pre spomínané vozidlo zabezpečil dodávateľ podvozku.
